Also today we have
received a final version of the Parkway Agreement.
The question is what to do tonight in terms of
acting upon the agreement. The agreement is being
considered by a number of other governmental
entities, however, they are not all meeting at the
same time. Tonight the agreement is being
considered by the City of Louisville and the City
of Lafayette. The City of Broomfield will not
consider it until sometime next week. As a result
of that there may be some additional amendments
being proposed to the draft of the final
agreement. It would be my recommendation as set
forth in my memo (see attachment B) to make a
motion that authorizes the Mayor to execute the
agreement on behalf of the City of Louisville
subject to various conditions.
At this time the City Attorney went through each
of the conditions on attachment B.
You may want to include a provision that the
agreement be executed by the cities and you have
to decide who you want to be assured will sign the
agreement. In my paragraph one I indicated that
the City of Broomfield, the City of Lafayette,
Boulder County, and the City of Boulder will
execute the agreement. I raise the question of the
Town of Superior because there has been various
comments made that the Town of Superior may not be
willing to execute the agreement. The question to
you is, is the City of Louisville willing to
execute the agreement if it is not executed by the
Town of Superior but is executed by all of the
other parties? The second question you have is
are you willing to sign the agreement if it is
also not signed by the City of Boulder?
There will likely be some non-substantive changes
made to the agreement that will not affect the
City of Louisville. In my memo I indicate that
you may want to say that non-substantive changes
or substantive changes not affecting the City of
Louisville may be made to the Agreement prior to
5
