--,.
section lines. We do not have the risk of
running into a situation where we have part of
it inside and part of it outside the proposed
areas.
Sackett: The area of risk I see is near the King
Soopers and the K-mart area up there, am I
right?
Brand: No, that is in Louisville's Fire Protection
District, South Boulder Road and 42.
Klein: That is within the Louisville Fire Protection
District. We drew the line on South 80th when
South 80th still existed and so that is on the
east side of South 80th. The little
triangular shapes that come in and out were
originally set up to allow for the Homart
Development but they have replatted it. We
anticipated that this would happen and that it
would be covered by Louisville but it was
replatted. That is where we ran into the,
property lines actually crossing boundary
lines.
Sackett: Does this agreement cover if it looked like
Louisville is going to get a 5,000 employee
employer where the property is partially in
Louisville's district and partially in
Cherryvale's district? Does this agreement
have a way to solve that or do we just say
that is up to the Fire Districts and the
employer says I don't have time to deal with
you?
Klein: The example would be the proposed Neo-Data
facilities. It would be an example of where
we would be covering part of the parking lot
intake and they would be covering output. In
this agreement, this land that is included in
this would eliminate that particular problem.
Again, in order for that to happen the City of
Louisville would have to annex the land in the
Cherryvale Fire District and replat it in such
a manner that the boundaries/lot lines would
go back in and out through existing lots. That
would be the only way I could see that
happening.
Davidson: If we do not approve this IGA what's the
process?
11
