open space; number two, there is existing
residential; number three, they can't get
sewer service. What we are saying is then,
agree to it. What you are saying now is that
you don't want to agree to that. That sends a
message to our Board that more of the district
is at risk because Loutsville having statutory
ability to annex as far as they want with the
exception of running into another
municipality, puts all that region at risk.
Carnival: I don't have any problem indicating that I
will not go out and encourage, but to say I
will not support then jumps back to Paragraph
11 which says you have the ability to exclude
yourself from the fire district. Those two
things are conflicting one another.
Klein: They can go with two processes; they have a
501 process that they can go.through at any
time, but the 502 process is when the City.
becomes involved. The City in the 502 process
has to be an active player. What we are
saying is that if you say you are not
intending to do that, then agree to it.
Carnival: Under the current situation you are indicating
in the 501 plan this would never have
happened, you would have never considered
excluding Ohmeda from your fire district.
Klein: No, what we have said here is that we are
agreeing to exclude more than just the Ohmeda
property. We are agreeing to exclude
properties that the City intends to annex in
the near future as part of your planning area
to avoid this specific conflict. What we're
saying is when it comes down to you filling
out your annexation plans from Sterling
Heights on top of Davidson Mesa and then on
the little corner up north, we are saying
these are reasonable response boundaries.
Instead of having to go through this or
instead of making the property owner jump
through a bunch of hoops to get out we will
automatically exclude them. We will
automatically exclude them and they will
automatically go on the Louisville Fire
Protection District.
Carnival: What about the two parcels on the south side
16
