We have come to a very strong <br />philosophical agreement on this and what will <br />happen as a natural course is that the <br />agreement will gain support both historically <br />and morally as the City of Louisville and the <br />Cherryvale Fire Protection District work <br />together for the next ten to fifteen years. <br />Mr. Klein wished to encourage the Council's <br />support. <br /> <br />Davidson: In Section 10 Louisville agrees it will not <br />encourage nor support any exclusion. As I <br />remember when we discussed this before the <br />Council agreed we wouldn't encourage but it <br />sounds to me like we wouldn't support a <br />property owner if they decided they wanted to <br />leave. The way I read this agreement it would <br />preclude us from supporting them. I don't <br />know that any property owner would want to do <br />that but I don't know if we particularly want <br />to sign away that right. <br /> <br />Brand: Kevin and I have talked about that in several <br />of our meetings. That is something that the <br />Cherryvale Board feels very strongly about. <br />Kevin could address that and also Susan can <br />comment on protection for the City of <br />Louisville. <br /> <br />Klein: Section 10 as the Cherryvale Fire Protection <br />District sees it is the crux of the agreement. <br />The 502 statute allows municipalities to <br />petition the District Court for exclusion. We <br />are asking that Louisville not enter into a <br />502 exclusion by providing service by contract <br />through the Louisville Fire Protection <br />District. By having that ability to do it <br />then, essentially this agreement means <br />nothing. The only thing we do is give up more <br />of the district's territory. It is important <br />to our district to see that steps have been <br />taken to protect our financial interest in the <br />future. I think that is both as staff and I <br />understand it. The proposed planning area of <br />the City of Louisville does not anticipate <br />going outside of that area. We'll draw the <br />boundary along that area and basically are <br />asking the City to put their money where their <br />mouth is when they say "we do not anticipate <br />or we do not see ourselves going beyond that <br /> <br />9 <br />
