Superior and Boulder County dated 20 June, 2000, (available in the Planning Depar trnent for <br />review if needed), that being the total completion of the Coal Creek/Rock Creek Trail. <br />With a permit, completion of the following could occur: 1) At this time, the bank of the <br />drainage ditch/swale leading to Coal Creek is un-stable and is eroding. Minor earthwork, <br />(shoring up the bank with riprap/boulders), associated with this permit could permit the <br />applicant to stabilize the bank; and 2) The recreational needs of the above mentioned parties <br />could be met, realizing the full potential of the Coal Creek/Rock Creek Trail System with this <br />important connection. <br />The property is zoned P-OS - Planned Community - Open Space and is actually an excess <br />part of the golf course property that contains the drive entrance to the golf course maintenance <br />building, a portion of the golf course, and the floodplain area for Coal Creek. <br />The applicant has provided sufficient information in the application packet provided to the <br />Board for review. An important item of note in the application is the Federal Emergency <br />Management Agency (FEMA) National Flood Insurance Program Floodplain Development <br />Permit - Elevation Certificate (EC) that if approved, will need to be sent to FEMA for <br />review and approval and kept on record with the City of Louisville. In conjunction with the <br />city, FEMA monitors development approved in floodplains. The Board of Adjustment most <br />recently reviewed and approved two like permits in 1997 and 1998. <br />DEVELOPMENT APPLICATION REFERRAL COMMENTS: <br />The Floodplain Development Permit application was sent to interested and/or affected City of <br />Louisville departments and agencies for any comments related to the issuance of said permit. <br />The following review comments were collected: <br />• PUBLIC SAFETY: No comments were registered. <br />• PUBLIC WORKS: "The Bridge should be designed to swing in large storm events and <br />should be anchored with a cable to the abutment." <br />This will be discussed in the following paragraphs. <br />• WASTEWATER DEPARTMENT: No comments were registered. <br />• URBAN DRAINAGE AND FLOOD CONTROL: No objection to this proposal. <br />REVIEW CRITERIA: <br />The Board of Adjustment has authority to hear and decide, grant or deny this application for a <br />Floodplain Development Permit pursuant to the powers granted the Board in § 17.48.110 C. <br />of the Louisville Municipal Code. The Board may grant a permit only if it makes findings that <br />all of the criteria, as established under § 17.56.160 A-E, have been satisfied, insofar as <br />applicable. The following regulations shall apply in the flood regulatory district and all areas <br />of special flood hazard: <br />• 17.56.160 A.
