COUNCIL COMMUNICATION
TO: MAYOR AND CITY COUNCIL
FROM: WILLIAM A. SIMMONS, CITY MANAGER
DATE: November 9, 2003
SUBJECT: Ordinances for Storm Water Quality, Potable Water Cross Connections and Street and
Rights of Way.
ORIGINATING DEPARTMENT: Public Works Department
SUMMARY:
Over the last few years there have been a number of laws and regulations adopted at the Federal and
State Level impacting Public Works operations. Many of these new laws require local ordinances be
adopted to provide for enforcement authority at the local government level. Two areas in which the City
of Louisville needs to adopt ordinances are storm water quality and potable water cross connections.
Additionally, the Public Works Department is requesting consideration of a new street and right of way
ordinance updating our current ordinance regarding authorization for work to be undertaken in, and
occupancy of, public rights of way.
Attached are three ordinances addressing the areas of concern more directly. At Tuesday's Work
Session staff will be available to discuss the need for the ordinances in greater detail and relate the
proposed ordinances to the Federal and State requirements for the City to have the stated authority and
answer questions. The ordinances will be presented to City Council for adoption beginning with the next
City Council meeting.
SUBJECT AGENDA ITEM
Ordinances for Storm Water Quality, Potable
Water Cross Connections and
Street and Rights of Way
I V.
