COUNCIL COMMUNICATION <br />TO: MAYOR AND CITY COUNCIL <br />FROM: WILLIAM A. SIMMONS, CITY MANAGER <br />DATE: November 9, 2003 <br />SUBJECT: Ordinances for Storm Water Quality, Potable Water Cross Connections and Street and <br />Rights of Way. <br />ORIGINATING DEPARTMENT: Public Works Department <br />SUMMARY: <br />Over the last few years there have been a number of laws and regulations adopted at the Federal and <br />State Level impacting Public Works operations. Many of these new laws require local ordinances be <br />adopted to provide for enforcement authority at the local government level. Two areas in which the City <br />of Louisville needs to adopt ordinances are storm water quality and potable water cross connections. <br />Additionally, the Public Works Department is requesting consideration of a new street and right of way <br />ordinance updating our current ordinance regarding authorization for work to be undertaken in, and <br />occupancy of, public rights of way. <br />Attached are three ordinances addressing the areas of concern more directly. At Tuesday's Work <br />Session staff will be available to discuss the need for the ordinances in greater detail and relate the <br />proposed ordinances to the Federal and State requirements for the City to have the stated authority and <br />answer questions.
