City Council <br /> Meeting Minutes <br /> June 1, 2010 <br /> Page 6 of 10 <br /> Mayor Pro Tem Marsella inquired about the land use criteria stipulating the number of <br /> MMC's within an area as opposed to grandfathering in an existing center and whether a <br /> limit can be set within the City's regulatory powers. City Attorney Light stated the <br /> separation requirements may mitigate the negative impacts of the businesses. <br /> Councilor Yarnell voiced her interest in using the regulatory powers to permit Medical <br /> Marijuana Centers in a manageable fashion. <br /> Mayor Sisk was concerned surrounding cities may ban MMC's and Louisville would <br /> become a center for other communities. He favored regulating marijuana for Louisville <br /> residents. He did not support putting this matter on the ballot and felt the City Council is <br /> capable of regulating medical marijuana. He suggested while the governor is <br /> deliberating his decision of HB 1284, the first reading of an ordinance extending the <br /> moratorium should be set. <br /> Council directed Staff to bring an ordinance forward on June 15 to extend the <br /> moratorium on Medical Marijuana Centers in the City of Louisville. <br /> RESOLUTION No. 31, SERIES 2010 A RESOLUTION APPROVING A REQUEST <br /> FOR A SPECIAL REVIEW USE (SRU) TO ALLOW FOR THE OPERATION OF A <br /> PRIVATE SCHOOL ON A PROPERTY LOCATED AT 1436 MAIN STREET AND <br /> ZONED COMMERCIAL NEIGHBORHOOD (CN) <br /> Mayor Sisk requested a Staff presentation. <br /> Planning Director Russ explained the applicant, Patchwork Elementary, is requesting a <br /> special review use (SRU) to allow for the operation of a private school on 1436 Main <br /> Street. This request was heard by the Planning Commission at the May 13, 2010 public <br /> hearing. Staff scheduled this matter for the first City Council meeting in June. Following <br /> publication of the June 1, 2010 City Council public hearing, the applicant requested a <br /> continuance. Staff recommended a continuance to June 15, 2010. <br /> MOTION: Mayor Sisk moved to continue Resolution No. 31, Series 2010 to the June <br /> 15, 2010, seconded by Councilor Clabots. All were in favor. Motion carried. <br /> RESOLUTION No. 32, SERIES 2010 A RESOLUTION APPROVING A SPECIAL <br /> REVIEW USE (SRU) TO ALLOW FOR OUTDOOR SEATING FOR AN EATING AND <br /> DRINKING ESTABLISHMENT LOCATED ON THE SOUTHERN 35 FEET OF LOT 8, <br /> BLOCK 2, LOUISVILLE OLD TOWN (808 MAIN STREET) <br /> Mayor Sisk requested a Staff presentation. <br /> Planning Director Russ explained the applicant, Lenny Martinelli of Zucca Italian <br /> Ristorante, has requested approval of a Special Review Use (SRU) to allow outdoor <br /> seating at 808 Main Street.
