Mayor Sisk closed the public hearing <br /> MOTION: Councilor Muckle moved to approve Ordinance No. 1573, Series 2010, on <br /> second and final reading, seconded by Councilor Dalton. Roll call vote was taken. The <br /> motion carried by a vote of 7-0. <br /> ORDINANCE No. 1574, SERIES 2010 AN ORDINANCE OF THE CITY OF <br /> LOUISVILLE EXTENDING THE TEMPORARY MORATORIUM ON THE <br /> ACCEPTANCE, PROCESSING, OR ISSUANCE OF APPLICATIONS OR <br /> REQUESTS FOR (BUSINESS REGISTRATION, SALES TAX LICENSES, <br /> BUILDING PERMITS, AND CERTIFICATES OF OCCCUPANCY FOR <br /> MEDICAL MARIJUANA DISPENSARIES WITHIN THE CITY OF LOUISVILLE <br /> 2nd Reading Public Hearing <br /> Mayor Sisk requested a City Attorney introduction. <br /> City Attorney Light read Ordinance No. 1574, Series 2010. <br /> Deputy City Manager Balser explained Ordinance No. 1574, Series 2010 extends the <br /> current moratorium on the acceptance, processing, or issuance of applications or <br /> requests for business registration, sales tax licenses, building permits, and certificates <br /> of occupancy for medical marijuana dispensaries within the City of Louisville. The <br /> current moratorium expires August 15, 2010. House Bi111284, concerning the regulation <br /> of medical marijuana on a state -wide basis, was approved by both houses of the <br /> Colorado Legislature and signed by Governor Ritter on June 7. <br /> The extension of the moratorium will allow additional time to investigate the City's ability <br /> to regulate commercial medical marijuana operations under HB1284, gain input on the <br /> options available to the City for addressing medical marijuana operations in the City, <br /> review any draft rules or adopted rules of the Department of Revenue and develop and <br /> implement any appropriate regulations or pursue exercise of a local option consistent <br /> with state law. <br /> The City's moratorium ordinance exempted the two existing MMDs "as such <br /> developments and uses existed on October 2009." The moratorium prohibits <br /> commencement of any production or growing of marijuana at a dispensary. Neither of <br /> the existing medical marijuana dispensaries in October of 09 was producing or growing <br /> at those locations, and each operator was advised at the issuance of their certificate of <br /> occupancy that production or growing at the dispensary is not allowed under City <br /> ordinances. Thus, the effect of the extension of the moratorium is to continue the <br /> prohibition on growing or production in Louisville. Regardless of the requirements in HB <br />
