LOUISVILLE BOARD OF ADJUSTMENT <br />STAFF REPORT <br />APRIL 7, 1993 <br />APPLICANT: David Lewis/Mona Newton <br />OWNER: Same <br />LOCATION: 708 Grant Avenue <br />ZONING: Residential Low Density - RL <br />REQUEST: Variance of two (2) feet to allow a five (5) foot side yard setback <br />rather than the required seven (7) feet in order to construct a two <br />story addition to an existing single family residence. <br />BACKGROUND: <br />The applicants are proposing to demolish a 19.8' x 15.7' portion of an existing residence <br />and utilize the existing foundation to construct a new two story addition. The property <br />consists of two platted lots which are each 25' wide by 125' deep. Total lot area for the <br />property is 6250 square feet. The existing residence was originally constructed in approxi- <br />mately 1908 and contains a total of 988 square feet. The existing structure is setback along <br />its entire length 5 feet from the north property line. The proposal is to rebuild in the same <br />location as the existing wall with a two foot cantilever extending to the east. The proposed <br />height of the addition is 25 feet from existing ground level to the peak of the roof. The <br />proposed height complies with the zoning ordinance requirements and does not require any <br />variance. The property also contains a 20' by 20' detached garage with a second story <br />room. Total lot coverage with the proposed addition would be approximately 26%. There <br />is a large, mature deciduous tree in the rear yard between the house and the garage. The <br />adjacent house to the north (720 Grant St.) is located 25' from the subject house. It is a <br />one and one-half story house with a dormer window facing south. There are also several <br />large first story windows facing south and a deck at the rear of the house. <br />VARIANCE CRITERIA: <br />The Board of Adjustment has authority (pursuant to the powers granted the Board in <br />section 17.48.110 of the Louisville Municipal Code) to hear and decide, grant or deny this <br />application for a variance to section 17.12.040 (yard & bulk requirements). The Board <br />may grant a variance only if it makes findings that all of the criteria, as established under <br />section 17.48.110, have been satisfied insofar as applicable: <br />1. That there are unique physical circumstances or conditions such as irregularity, <br />narrowness or shallowness of lot, or exceptional topographical or other physical <br />conditions peculiar to the affected property. The staff finds that this criterion is <br />met. The exceptional physical condition is the location of the existing structure on <br />the property. Said structure was constructed prior to adoption of the Louisville <br />zoning ordinance establishing a 7' side yard setback and is a legal non -conforming <br />structure. <br />
