South <br /> Boulder Road 3/11/10 Incident <br /> Chairperson Lipton opened the hearing. Attorneys for the Authority and for the <br /> Licensee re- introduced themselves for the record. Ms. Brown, Special Prosecutor <br /> for the Authority, presented a stipulation. The stipulation dismissed all but the <br /> violation of Regulation 47 -302A of the Colorado Liquor Code, Code of <br /> Regulations concerning modifying licensed premises. The stipulation proposed a <br /> seven day suspension with four days held in abeyance with three days served <br /> concurrent with the previous stipulation. The stipulation also addressed how the <br /> premises would operate during the time between now and the time of the next <br /> Authority meeting. There was a misunderstanding of how the modification was <br /> presented in January and how it is now being operated. The issues concerned <br /> the entry/exit through the outside door, the signage above the entrance "Sideline <br /> Pub use of the room, and placement of Warning signs as required by the State <br /> over the bar area. <br /> Mr. Dill stated the presentation in January misled the Authority concerning use of <br /> the modified area. <br /> Authority Member Wilson addressed the concern of meal service and snack <br /> availability after the main part of the restaurant was closed. <br /> Mr. Dill agreed some Tight snacks needed to be available after 8 p.m. Mr. Brasel <br /> mentioned the deep fat fryer would be operational, so chicken fingers and any of <br /> the fried items would be available. <br /> The licensee was asked if the warning signs were posted in the bar area. Mr. Dill <br /> stated those signs were not posted in the new area. Secretary Hanson provided <br /> the licensee with the signs to post. <br /> Rommelfanger asked about the statements in the police report about the monies <br /> from the modified area being separate. Mr. Dill stated the monies had never <br /> been separate and the person making the statement clearly misunderstood and <br /> misstated the facts. All tax payments on revenue have been reported and all <br /> income has been reported in E3eef "0" Brady's name. <br /> Sergeant Lanphere reported he felt the establishment was doing a good job of <br /> working with the employees, the Authority, and the police department.
