Local Licensing Authority Minutes April 26, 2010 Page 4 of 6 Gunning moved the Authority set the dates of suspension for the licensee as May 29, 30, and 31, 2010 and the records for calculating the fine in lieu of suspension be records for March 13, 14 and 15, 2010. Show Cause Hearing Village Square B "O" B d /b /a Beef "0" Brady's Hotel and Restaurant Liquor License 585 E. South Boulder Road 3/11/10 Incident Chairperson Lipton opened the hearing. Attorneys for the Authority and for the Licensee re- introduced themselves for the record. Ms. Brown, Special Prosecutor for the Authority, presented a stipulation. The stipulation dismissed all but the violation of Regulation 47 -302A of the Colorado Liquor Code, Code of Regulations concerning modifying licensed premises. The stipulation proposed a seven day suspension with four days held in abeyance with three days served concurrent with the previous stipulation. The stipulation also addressed how the premises would operate during the time between now and the time of the next Authority meeting. There was a misunderstanding of how the modification was presented in January and how it is now being operated. The issues concerned the entry/exit through the outside door, the signage above the entrance "Sideline Pub use of the room, and placement of Warning signs as required by the State over the bar area. Mr. Dill stated the presentation in January misled the Authority concerning use of the modified area. Authority Member Wilson addressed the concern of meal service and snack availability after the main part of the restaurant was closed. Mr. Dill agreed some Tight snacks needed to be available after 8 p.m. Mr. Brasel mentioned the deep fat fryer would be operational, so chicken fingers and any of the fried items would be available. The licensee was asked if the warning signs were posted in the bar area. Mr. Dill stated those signs were not posted in the new area. Secretary Hanson provided the licensee with the signs to post. Rommelfanger asked about the statements in the police report about the monies from the modified area being separate. Mr. Dill stated the monies had never been separate and the person making the statement clearly misunderstood and misstated the facts. All tax payments on revenue have been reported and all income has been reported in E3eef "0" Brady's name. Sergeant Lanphere reported he felt the establishment was doing a good job of working with the employees, the Authority, and the police department. He felt
