She also noted that people <br />develop strategies for coping with traffic problems. <br /> <br />Hartman stated that she would like to see the Build Green program for any new developments. <br />There is still a problem with traffic safety and access to the development. The density is too <br />much. She does not support the development. <br /> <br />Sheets stated that she likes the plan. She still has concerns with traffic safety, HOA cost, density <br />of25 seems a little high but still appreciates the density. The city receives a benefit with the <br />dedicated open space on the west side of McCaslin. That property has development potential but <br />will be used to create a buffer for the city. McStain has created some very nice buffers between <br />the new area and the already established neighborhoods. She is not clear as to what has changed <br />with traffic since the original approval of the Gateway Subdivision that makes the concerns <br />today any different then they were at original development approval. She also likes the gateway <br />that the development is creating for the city. <br /> <br />Lipton moved and Loo seconded a motion to approve Resolution 25, Series 2006 as presented by <br />Staff with the following nine conditions: <br />1. The applicant shall revise the final PUD submittal to reflect the elimination of a <br />minimum combined side yard setback, and that the side yard setback be increased to 12 '. <br />2. For the Final, Staffwill revise the existing Development Agreement to establish new <br />public improvement guarantees. <br />3. The Fire Marshall will need final sign off for the emergency access shown in Tract E. <br />The applicant should provide a detail of how the access will be designed (depth, <br />thickness of pavers bollards, etc.) <br />4. Emergency access is required to have year round maintenance, including snow removal, <br />that will be maintained by the HOA. Please make note of that on the final PUD. <br />5. Please clarifY intent of vacating the 20' sewer easement on the east side of the property. <br />6. Determine how the private open space tracts will be used Establish a note on the PUD <br />that designates if the space will be used for public access or if it is just a visual buffer. <br />Include what uses will be allowed <br />7. Prior to approval of afinal PUD, the applicant must provide a written guarantee that the <br />Outlots west of McCaslin Drive are to be dedicated to the City of Louisville for open <br />space and view shed protection. <br />8. Gateway Lane shall be designed to City of Louisville public street standards that has 36' <br />of asphalt and sidewalks on both sides of the street. Please contact the City of Louisville <br />Public Works Department for street design standards. <br />9. Applicant shall include a note on the Development Agreement that states "any future <br />improvements, such as a traffic signal, median or road improvements to McCaslin Blvd <br />or South Boulder Road, should be incurred by the Home Owners Association ". <br /> <br />Dalton offered a friendly amendment to remove Condition #9.
