• Staff find the modification requests are in conformance with the purpose and <br />intent of Title 16 and 17 as well as adopted plans and policies, because the <br />proposed subdivision would promote smaller homes on smaller lots with a mix <br />of street and alley access, which is consistent with the neighborhood <br />character. Since the property is currently permitted by -right for up to three <br />dwellings, staff find the modifications support the development of the <br />additional units. <br />2. Section 16.24.030.A-Modification review criteria: <br />1. That there are unique physical circumstances or conditions such as <br />irregularity, narrowness or shallowness of the property, or exceptional <br />topographical conditions, or other physical conditions peculiar to the <br />affected property; <br />• Staff find that the application meets this criterion because the existing <br />lots are uniquely narrow, with lot depths exceeding eight times the lot <br />widths. <br />2. That because of such physical circumstances or conditions, the property <br />cannot be reasonably developed in conformity with the provisions of title <br />16 and title 17 resulting in a hardship; <br />• Staff find that the lot lines must be adjusted if the applicant intends to <br />construct three dwellings on the lot, which is permitted based on total <br />square footage of the property with the current R-M zoning. <br />• Staff find that the proposed subdivision will allow for development of <br />three houses on the lots because each lot will be wider, shallower, <br />and will be allotted more square footage than the existing lots (see <br />Table 1 below). <br />Table 1.
