THIS AGREEMENT is made and entered into this day of <br />, 1999, by and between the TOWN OF SUPERIOR, a <br />municipal corporation of the State of Colorado, hereinafter <br />referred to as "Superior" acting by and through its Mayor and Town <br />Clerk, upon the prior approval and authority of its Board of <br />Trustees, and the CITY OF LOUISVILLE, a municipal corporation of <br />the State of Colorado, hereinafter referred to as "Louisville" <br />acting by and through its Mayor and City Clerk, upon the prior <br />approval and authority of its City Council. <br /> <br />w I T N E S E T H: <br /> <br /> WHEREAS, on January 21, 1992, Superior and Louisville entered <br />into a Sewer Agreement whereby Louisville would collect and treat <br />sewage for Superior for specified fees (hereinafter referred to as <br />"the 1992 Sewer Agreement"); and <br /> <br /> WHEREAS, Superior has implemented and installed its own sewage <br />collection and treatment system which adequately meets the <br />anticipated needs of the present and future inhabitants of <br />Superior; and <br /> <br /> WHEREAS, Superior no longer desires to obtain <br />collection and treatment from Louisville; and <br /> <br />sewage <br /> <br /> WHEREAS, Superior and Louisville each recognize that it is in <br />its best interests to rescind the 1992 Sewer Agreement. <br /> <br /> NOW, THEREFORE, Superior and Louisville agree that the 1992 <br />Sewer Agreement, a copy of which is attached hereto, is hereby <br />rescinded in its entirety. <br /> <br /> IN WITNESS WHEREOF, Superior and Louisville have executed this <br />Agreement in duplicate original counterparts. <br /> <br />TOWN OF SUPERIOR, COLORADO <br /> <br />CITY OF LOUISVILLE, COLORADO <br /> <br />By: <br /> <br />Tom Davidson, Mayor <br /> <br />ATTEST: ATTEST: <br /> <br />~ylli~ Hardin, Town Clerk <br /> <br />By: <br /> <br />Dave Clabots, Town Clerk <br /> <br />021099/1829 [sj 1] c: Lvit le\Sewer, agm <br /> <br /> <br />
