ORDINANCE NO. 1700 <br />SERIES 2015 <br />AN ORDINANCE AMENDING CHAPTER 13.32 OF THE LOUISVILLE MUNICIPAL <br />CODE REGARDING SEWER USE REGULATIONS <br />WHEREAS, the City Council desires to amend Chapter 13.32 of the Louisville Municipal <br />Code to reflect changes in federal and state regulations; and <br />WHEREAS, the City Council desires to amend Chapter 13.32 of the Louisville Municipal <br />Code to update local limits for permitted industrial and non - industrial users and non - permitted <br />users; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The following definitions in Section 13.32.020 of the Louisville Municipal <br />Code are hereby amended as follows (words to be deleted are s* Through; words to be added <br />are underlined) with the remainder of the definitions in said section to remain the same: <br />§13.32.020. Definitions. <br />Fats, oil or grease (FOG) means any hydrocarbons, fatty acids, soaps, <br />fats, waxes, oils and any other material that is extracted by Freon hexane solvent, <br />as specified in 40 CFR 136.3. <br />Significant Industrial User <br />B. Upon a finding that an industrial user meeting the criteria in paragraph A.1, 2, <br />3 or 4 of this definition has no reasonable potential for adversely affecting the <br />POTW's operation or for violating any pretreatment standard or requirement, the <br />control authority . - -: - • ! "' ' ! . • may at any time, on its own <br />initiative or in response to a petition received from an industrial user or POTW, <br />and in accordance with 40CFR 403.8(0(6), determine that such industrial user is <br />not a significant industrial user. <br />Violation means any pollution pollutant concentration or mass loading <br />which exceeds effluent limitations defines defined by section 13.32.120 or in the <br />discharge permit issued under this chapter; any failure to provide adequate and <br />timely reports required by a permit; any failure to abide by any management <br />conditions required by a permit or this chapter; or any failure to abide by the <br />terms, conditions and restrictions of this chapter, a permit issued hereunder or <br />applicable federal or state regulations. <br />Ordinance No. 1700, Series 2015 <br />Page 1 of 6 <br />
