RESOLUTION NO. 40 <br />SERIES 2000 <br /> <br />A RESOLUTION ADOPTING A STANDARD FORMAT REVOCABLE <br />LICENSE AGREEMENT FOR CITY-OWNED REAL PROPERTY AND <br />AUTHORIZING THE CITY ADMINISTRATOR TO EXECUTE THE <br />SAME UNDER PRESCRIBED CIRCUMSTANCES. <br /> <br /> WHEREAS, it is often necessary and desirable to locate improvements other than those <br />owned by the City or installed pursuant to City franchise upon City-owned property; and <br /> <br /> WHEREAS, the City often receives the dedication of outlots and other parcels of property <br />within subdivisions as part of a subdivision approval where the residents of the subdivision, acting <br />through their homeowners' association, desire to provide and maintain landscaping beyond the <br />landscaping and maintenance which would otherwise be provided by the City; and <br /> <br /> WHEREAS, for aesthetic, safety or other reasons, the City at times finds it necessary or <br />desirable to allow location of other improvements, such as fencing, awnings or similar items, on <br />City-owned property; and <br /> <br /> WHEREAS, these and other such uses of City-owned property often promote the orderly <br />development of the community or enhance the aesthetic and visual qualities of the City and result in <br />other such benefits to the community; and <br /> <br /> WHEREAS, the use of City owned property for installation of such improvements, <br />landscaping or other uses often requires that the party responsible for said improvements have <br />access to the City-owned property on which the use is made for the purpose of maintenance, repair <br />and other such activities; and <br /> <br /> WHEREAS, the City has determined that it is desirable to set forth the terms and <br />conditions for the use of City-owned property by said parties and has developed a standard format <br />revocable license agreement for the purpose of granting permission to use City-owned property; and <br /> <br /> WHEREAS, the City Council wishes to formally authorize the City Administrator to <br />execute, on behalf of the City, certain revocable license agreements for the use of City-owned real <br />property. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br /> 1. The City hereby approves of the use of the standard format Revocable License <br />Agreement attached hereto for the purpose of granting a revocable personal privilege to use City- <br />owned property for the purposes of installing and maintaining utility and drainage related <br /> <br /> <br />
