<br /> ORDINANCE NO. 1491 <br /> SERIES 2006 <br />AN ORDINANCE AMENDING CHAPTER 17.48 OF THE <br /> LOUISVILLE MUNICIPAL CODE REGARDING <br /> THE BOARD OF ADJUSTMENT. <br />WHEREAS, the City Council desires to amend certain sections ofthe Louisville Municipal <br />Code to allow for an associate member ofthe Board of Adjustment, to recognize the position of vice- <br />chair of the Board, and to prescribe the method of notice of hearings on variance applications; and <br />WHEREAS, the City has determined that it is in the best interest of the citizens of the City to <br />amend the Louisville Municipal Code as set forth herein. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. Section 17.48.030 ofthe Louisville Municipal Code is hereby amended to read <br />as follows (words to be added are underlined; words to be deleted are stricken through): <br />Sec. 17.48.030. Members-Term; associate members. <br />A. Appointments to the board of adjustment shall be for a period ofthree <br />years, except that, when vacancies occur prior to the expiration of a regular term, they <br />shall be filled in the same manner as regular appointments but shall serve only until <br />the expiration of the term in which the vacancy occurred. <br />B. In addition to the regular members of the board of adiustment, the city <br />council may appoint one associate member for a three-year term. In the event that <br />any regular member of the board of adiustment is temporarily unable to act owing to <br />absence from the city, illness, interest in a case before the board of adiustment, or any <br />other cause, the absent member's place may be taken during such time by the <br />associate member who shall have all the powers of a regular member while serving in <br />the place of a regular member except that the associate member shall not serve as the <br />chair or vice-chair of the board of adiustment. <br />Section 2. Section 17.48.040 ofthe Louisville Municipal Code is hereby amended to read <br />as follows (words to be added are underlined; words to be deleted are stricken through): <br />Sec. 17.48.040. Chairmau- and vice-chair. <br />Members of the board of adjustment shall elect from their members by <br />majority vote a chairmaH: and vice-chair to serve for a term~ of one:year. <br /> 1 <br />
