<br /> ORDINANCE NO. 1497 <br /> SERIES 2006 <br />AN ORDINANCE AMENDING SECTION 17.12.040 OF THE LOUISVILLE MUNICIPAL <br />CODE AND THE DESIGN HANDBOOK FOR DOWNTOWN LOUISVILLE TO <br />INCREASE THE MAXIMUM BUILDING HEIGHT IN THE OLD TOWN <br />COMMERCIAL COMMUNTY (C-C) AND COMMERCIAL BUSINESS (C-B) ZONE <br />DISTRICTS; AMENDING RELATED PROVISIONS OF THE LOUISVILLE <br />MUNICIPAL CODE AND COMMERCIAL DEVELOPMENT DESIGN STANDARDS <br />AND GUIDELINES REGARDING BUILDING HEIGHTS FOR THE COMMERCIAL <br />NEIGHBORHOOD (C-N), C-C AND C-B ZONE DISTRICTS; AND AMENDING <br />SECTION 17.12.060 OF THE LOUISVILLE MUNICIPAL CODE TO EXCEPT CITY- <br />OWNED BUILDING SQUARE FOOTAGE FROM THE FLOOR AREA LIMITATION <br />SET FORTH IN SUCH SECTION <br />WHEREAS, the City of Louisville is a Colorado home rule municipal corporation duly <br />organized and existing under laws of the State of Colorado and the City Charter; and <br />WHEREAS, pursuant to such home rule authority and state law, including but not limited <br />to c.R.S. SS 24-67-101 et seq., 29-20-101 et seq., 31-23-201 et seq. and 31-23-301 et ~ the City <br />is empowered to adopt procedures and standards pertaining to planned unit developments (PUDs); <br />to establish zoning districts and zone district regulations within the City for the purpose of, among <br />other things, promoting the general welfare of the inhabitants of the City; and to regulate and <br />restrict, among other things, the size of buildings and other structures; the percentage of lot that <br />may be occupied; the size of yards, courts, and other open spaces; the density of population; and the <br />location and use of buildings, structures, and land for trade, industry, residence, or other purposes; <br />and <br />WHEREAS, by Ordinance No. 1286, Series 1998, the City Council adopted a maximum <br />building height of29 feet for the Old Town C-C zone district; and <br />WHEREAS, by Ordinance No. 1294, Series 1999, the City Council adopted a maximum <br />floor area within the Westerly Portion of Downtown Louisville as further defined and set forth in <br />such Ordinance; and <br />WHEREAS, the City Council by this ordinance desires to amend the maximum building <br />height limitation adopted by Ordinance No. 1286 Series 1998, and the maximum floor area adopted <br />by Ordinance No. 1294, Series 1999; and <br />WHEREAS, the City Council by this ordinance desires to amend related provisions of the <br />Louisville Municipal Code and Commercial Development Design Standards and Guidelines to <br />reflect such change in building heights, and to clarify currently applicable building height limits in <br />the City's commercial zone districts; and <br />WHEREAS, the City Council desires to promote a vibrant and economically stable <br /> 1 <br />
