<br /> ORDINANCE NO. 1503 <br /> SERIES 2006 <br /> AN ORDINANCE ENACTING A NEW CHAPTER 13.37 OF THE CITY OF <br /> LOUISVILLE MUNICIPAL CODE REGARDING THE CITY'S STORMW ATER <br /> MANAGEMENT PROGRAM AND STORMW A TER UTILITY FEES <br /> WHEREAS, the City Council desires to set forth by ordinance certain provisions of the <br /> City's stormwater management program and to establish stormwater utility fees to assist in the <br /> financing of stormwater improvements to serve the City, to defray the costs of operating and <br /> maintaining stormwater improvements and facilities, and for other costs associated with the City's <br /> stormwater management program; <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br /> OF LOUISVILLE, COLORADO: <br /> Section 1. The Louisville Municipal Code is hereby amended by the addition of a new <br /> chapter 13.37 to read as follows: <br /> Chapter 13.3 7 <br /> STORMWATER PROGRAM RATES AND BILLING <br /> Sec. 13.37.010. General purpose and policy. <br /> Sec. 13.37.020. Definitions. <br /> Sec. 13.37.030. Establishing a stormwater program. <br /> Sec. 13.37.040. Establishing a stormwater utility fee. <br /> Sec. 13.37.050. Use of service fees. <br /> Sec. 13.37.060. Administrativt: and judicial review. <br /> Sec. 13.37.070. Enforcement and penalties. <br /> Sec. 13.37.010. General purpose and policy. <br /> A. This chapter is adopted to further the purpose of the City to construct, operate, and <br /> maintain stormwater facilities for its own use and for the use of public and private users within and <br /> without the territorial boundaries of the City, and to establish a methodology and requirement for the <br /> payment of reasonable stormwater utility fees for property owners to pay for a share of the costs of <br /> improvements and facilities reasonably necessary to manage stormwater. <br /> B. Furthermore, this chapter will promote the general public health, safety and welfare <br /> by reducing the potential for the movement of emergency vehicles to be impeded or inhibited during <br /> storm or flooding periods; by minimizing storm and flood losses, inconvenience, and damage <br /> resulting from runoff; and by promoting activities which improve the water quality of runoff in the <br /> City of Louisville. <br /> -1- <br />
