ORDINANCE NO. 1597 SERIES 2011 AN ORDINANCE AMENDING TITLE 17 OF THE LOUISVILLE MUNICIPAL CODE TO CREATE AN OPEN SPACE ZONE DISTRICT AND DISTRICT REGULATIONS, AND REZONING CERTAIN CITY -OWNED PARCELS TO OPEN SPACE WHEREAS, the City of Louisville is a Colorado home rule municipal corporation duly organized and existing under laws of the State of Colorado and the City Charter; and WHEREAS, pursuant to such home rule authority and state law, including but not limited to C.R.S. 24-67-101 et seq., 29-20-101 et seq., 31 -23 -201 et seq. and 31 -23 -301 et seq., the City is empowered to establish zoning districts and zone district regulations within the City for the purpose of, among other things, promoting the general welfare of the inhabitants of the City; and to regulate and restrict, among other things, the size of buildings and other structures; the percentage of lot that may be occupied; the size of yards, courts, and other open spaces; the density of population; and the location and use of buildings, structures, and land for trade, industry, residence, or other purposes; and WHEREAS, Section 15 -3 (b) of the City Charter requires that the City's ordinances provide for an open space zone district into which shall be placed all land which is located wholly within the City and which has been designated as open space in accordance with Section 15 -3 (a) of the City Charter; and WHEREAS, the City's ordinances do not currently provide for an open space zone district in accordance with Section 15 -3 (b) of the City Charter; and WHEREAS, the City Council by this ordinance desires to amend Title 17 of the Louisville Municipal Code to establish an open space zone district and associated regulations; and WHEREAS, the City Council by this ordinance desires to rezone certain City -owned properties as open space; and WHEREAS, the legal descriptions of the City -owned properties which are to be rezoned as open space pursuant to this ordinance are set forth in Exhibit B attached hereto; and WHEREAS, the Louisville Planning Commission, after notice by publication and a public hearing, has recommended the City Council approve the amendments to Title 17 and the rezonings of City -owned parcels as set forth in this ordinance; and WHEREAS, the Louisville Open Space Advisory Board has at public meetings reviewed the amendments to Title 17 and the rezoning of City -owned parcels as set forth in this ordinance, and has recommended the City Council approve such amendments and rezoning; and WHEREAS, the City Council finds that the rezoning of City -owned parcels as set forth in this ordinance is consistent with the goals and policies of the Citywide Comprehensive Plan and with the City Charter and applicable provisions of the Louisville Municipal Code; and WHEREAS, City Council has provided notice of a public hearing on said ordinance by publication as provided by law and held a public hearing as provided in said notice; Ordinance No. 1597, Series 2011 Page 1 of 3
