ORDINANCE NO. 1597 <br /> SERIES 2011 <br /> AN ORDINANCE AMENDING TITLE 17 OF THE LOUISVILLE MUNICIPAL CODE TO CREATE <br /> AN OPEN SPACE ZONE DISTRICT AND DISTRICT REGULATIONS, AND REZONING <br /> CERTAIN CITY -OWNED PARCELS TO OPEN SPACE <br /> WHEREAS, the City of Louisville is a Colorado home rule municipal corporation duly <br /> organized and existing under laws of the State of Colorado and the City Charter; and <br /> WHEREAS, pursuant to such home rule authority and state law, including but not limited to <br /> C.R.S. 24-67-101 et seq., 29-20-101 et seq., 31 -23 -201 et seq. and 31 -23 -301 et seq., the City <br /> is empowered to establish zoning districts and zone district regulations within the City for the <br /> purpose of, among other things, promoting the general welfare of the inhabitants of the City; and to <br /> regulate and restrict, among other things, the size of buildings and other structures; the percentage <br /> of lot that may be occupied; the size of yards, courts, and other open spaces; the density of <br /> population; and the location and use of buildings, structures, and land for trade, industry, <br /> residence, or other purposes; and <br /> WHEREAS, Section 15 -3 (b) of the City Charter requires that the City's ordinances provide <br /> for an open space zone district into which shall be placed all land which is located wholly within the <br /> City and which has been designated as open space in accordance with Section 15 -3 (a) of the City <br /> Charter; and <br /> WHEREAS, the City's ordinances do not currently provide for an open space zone district <br /> in accordance with Section 15 -3 (b) of the City Charter; and <br /> WHEREAS, the City Council by this ordinance desires to amend Title 17 of the Louisville <br /> Municipal Code to establish an open space zone district and associated regulations; and <br /> WHEREAS, the City Council by this ordinance desires to rezone certain City -owned <br /> properties as open space; and <br /> WHEREAS, the legal descriptions of the City -owned properties which are to be rezoned as <br /> open space pursuant to this ordinance are set forth in Exhibit B attached hereto; and <br /> WHEREAS, the Louisville Planning Commission, after notice by publication and a public <br /> hearing, has recommended the City Council approve the amendments to Title 17 and the <br /> rezonings of City -owned parcels as set forth in this ordinance; and <br /> WHEREAS, the Louisville Open Space Advisory Board has at public meetings reviewed <br /> the amendments to Title 17 and the rezoning of City -owned parcels as set forth in this ordinance, <br /> and has recommended the City Council approve such amendments and rezoning; and <br /> WHEREAS, the City Council finds that the rezoning of City -owned parcels as set forth in <br /> this ordinance is consistent with the goals and policies of the Citywide Comprehensive Plan and <br /> with the City Charter and applicable provisions of the Louisville Municipal Code; and <br /> WHEREAS, City Council has provided notice of a public hearing on said ordinance by <br /> publication as provided by law and held a public hearing as provided in said notice; <br /> Ordinance No. 1597, Series 2011 <br /> Page 1 of 3 <br />
