ORDINANCE NO. 1609 <br /> SERIES 2011 <br /> AN ORDINANCE AMENDING SECTIONS 17.08.590 AND 17.16.100 OF THE <br /> LOUISVILLE MUNICIPAL CODE TO CHANGE THE MEASURING POINT FOR <br /> VISION CLEARANCE AREAS AND ADD VISION CLEARANCE AREAS FOR ALLEY <br /> INTERSECTIONS IN DOWNTOWN LOUISVILLE AND FOR INTERSECTIONS <br /> BETWEEN A STREET AND A RECREATIONAL PATH IN ALL OF LOUISVILLE <br /> WHEREAS,the City of Louisville is a home rule municipal corporation organized under <br /> and pursuant to Article XX of the Colorado Constitution and the Louisville Home Rule Charter; <br /> and <br /> WHEREAS, the City has previously adopted regulations establishing Vision Clearance <br /> Areas at all intersections of public rights-of-way; and <br /> WHEREAS, Section 17.16.100 of the Louisville Municipal Code (LMC) contains <br /> specific regulations with regards to Vision Clearance Areas, as defined in Section 17.08.590 of <br /> the LMC; and <br /> WHEREAS, Vision Clearance Areas are currently measured from the lot lines of the <br /> properties adjacent to the right-of-way; and <br /> WHEREAS, other jurisdictions instead measure Vision Clearance Areas from the curb <br /> line of the streets; and <br /> WHEREAS, measuring Vision Clearance Areas from the curb line instead of the lot line <br /> will allow fuller and better use of property on corners; and <br /> WHEREAS, there will be no decrease in safety for automobiles, cyclists, or pedestrians <br /> at intersections if Vision Clearance Areas are measured from curb lines; and <br /> WHEREAS, it will enhance pedestrian and cyclist safety to establish Vision Clearance <br /> Areas for alley intersections in Downtown Louisville and for recreational path intersections in all <br /> of Louisville; and <br /> WHEREAS, the establishment of Vision Clearance Areas for alley intersections in <br /> Downtown Louisville and for recreational path intersections in all of Louisville will have <br /> minimal impacts on property development at these intersections; and <br /> WHEREAS, after a duly noticed public hearing held November 17, 2011, where <br /> evidence and testimony were entered into the record, including the findings in the Louisville <br /> Planning Commission Staff Report dated November 17, 2011, the Louisville Planning • <br /> Commission has recommended the City Council approve the amendments to the LMC set forth <br /> in this ordinance; and j. <br /> Ordinance No. 1609, Series 2011 <br /> Page 1 of 3 <br />
