ORDINANCE NO. 1226 SERIES 1996 AN ORDINANCE CALLING A SPECIAL ELECTION FOR NOVEMBER 5 1996, TO BE CONDUCTED AS A COORDINATED ELECTION, TO REFER A BALLOT ISSUE TO A VOTE OF THE REGISTERED ELECTORS OF THE CITY, AND ELECTING TO UTILIZE THE REQUIREMENTS OF THE UNIFORM ELECTION CODE OF 1992. WHEREAS, the City Council finds it is in the best interest of the City of Louisville to call a special election for November 5, 1996, to be conducted as a coordinated election, and refer a ballot issue to a vote of the registered electors of the City at such special municipal election pursuant to Article X, Section 20 of the Colorado Constitution. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. A special municipal election is hereby called to be held on November 5, 1996. Section 2. The November 5, 1996 special municipal election shall be conducted as part of a coordinated election. Pursuant to Section 31-10-102.7 of the Colorado Municipal Election Code of 1965, the City will utilize the requirements and procedu~es of the Uniform Election Code of 1992 in lieu of the Colorado ~Municipal Election Code of 1965 for the conduct of the special election. Section 3. The following ballot issue, certified in substantially the form set forth below, is hereby referred to the registered electors of the City and shall appear on the ballot of the City of Louisville special municipal election to be held on November 5, 1996: SHALL THE CITY OF LOUISVILLE, COLORADO BE PERMITTED TO COLLECT, RETAIN, AND EXPEND THE FULL PROCEEDS OF THE CITY'S SALES AND USE TAX COLLECTED AND RECEIVED DURING THE YEAR 1996 AND EACH SUBSEQUENT YEAR, FOR CAPITAL PROJECTS, BASIC MUNICIPAL SERVICES OR OTHER LAWFUL MUNICIPAL PURPOSES, NOTWITHSTANDING ANY STATE LIMITATION ON FISCAL YEAR REVENUE AND SPENDING, INCLUDING WITHOUT 1
