FAILED 11/05/07 <br />ORDINANCE NO. 1528 <br />SERIES 2007 <br />AN ORDINANCE AMENDING CHAPTER 9.34 OF THE LOUISVILLE <br />MUNICIPAL CODE TO ADOPT NEW REGULATIONS REGARDING <br />EXCESSIVE SOUND LEVELS, AND MAKING RELATED AMENDMENTS TO <br />THE LOUISVILLE MUNICIIPAL CODE <br />WHEREAS, the City is authorized pursuant to its home rule charter and state <br />law, including but not limited t:o C.R.S. §§25-12-101 et sec. and 31-15-401 et sue., to <br />regulate excessive noise; and <br />WHEREAS, the City Council finds that it is necessary and appropriate to amend <br />the Louisville Municipal Code to adopt additional provisions regulating excessive noise; <br />and <br />WHEREAS, the City Council finds that the amendments to the Louisville <br />Municipal Code set forth herein are in the best interests of the health, safety and welfare <br />of the City and its residents; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br />THE CITY OF LOUISVILE, COLORADO: <br />Section 1. The title of Chapter 9.34 of the Louisville Municipal Code is hereby <br />amended to read "Noise and Disburbances." <br />Section 2. Sections 9.34.010, 9.34.020, 9.34.030 and 9.34.040 of the Louisville <br />Municipal Code are hereby renumbered as, respectively, Sections 9.34.080, 9.34.090, <br />9.34.100 and 9.34.110. <br />Section 3. Chapter 9,.34 of the Louisville Municipal Code is hereby amended by <br />the additional of new Sections 9.;;4.010 through 9.34.070, to read as follows: <br />Sec. 9.34.010. Legislative intent. <br />The purpose of this chal-ter is to protect the public health, safety, and welfare by <br />defining those noises and sounds which by their volume or other physical characteristics, <br />and, depending on their time, place, and manner, disturb people of normal sensitivity, and <br />to regulate such noises and sounds to the extent that can be done without detrimentally <br />affecting necessary residential, commercial, and governmental activities. It is not the <br />intention of the council to differentiate on the basis of the content, if there be any, of the <br />prohibited sounds.
