ORDINANCE NO. 1645, <br /> SERIES 2013 <br /> AN ORDINANCE INCREASING THE MAXIMUM FINES FOR MUNICIPAL <br /> ORDINANCE VIOLATIONS AND AMENDING OTHER PROVISIONS OF THE <br /> LOUISVILLE MUNICIPAL CODE CONCERNING SEXUALLY ORIENTED <br /> BUSINESSES,ARSON, CONTEMPT,SPEEDING AND BICYCLE VIOLATIONS <br /> WHEREAS, the Colorado Legislature during the 2013 legislative session adopted House <br /> Bill 13-1060, which increases the maximum fine a municipal court may impose for violations of <br /> municipal ordinances from $1,000 to $2,650 to be adjusted annually for inflation; and <br /> WHEREAS, the City Council desires to amend the Louisville Municipal Code to increase <br /> maximum fines for violations of municipal ordinances; and <br /> WHEREAS, the City Council also desires to increase fines for violations of other specified <br /> ordinances, including for bicycle violations and contempt of court, to amend provisions of the <br /> Louisville Municipal Code concerning arson, and to amend the Model Traffic Code concerning <br /> speeding; and <br /> WHEREAS, the City Council further desires to change the hearing officer for revocations of <br /> sexually oriented business licenses from the City Clerk to the Municipal Judge; <br /> NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br /> OF LOUISVILLE, COLORADO: <br /> Section 1. Subsection A of Section 1.28.010 of the Louisville Municipal Code is hereby <br /> amended to read as follows (words added are underlined; words deleted are str .): <br /> Sec. 1.28.010. General penalty. <br /> A. No person shall violate any of the provisions of the ordinances of the <br /> city. Except in cases where a different punishment is prescribed by any ordinance of <br /> the city, any person who violates any of the provisions of the ordinances of the city <br /> shall be punished by a fine of not more then—$4 000:90 than $2,650, as shall be <br /> adjusted for inflation on January 1, 2014 and on January 1 of each year thereafter, or <br /> by imprisonment not to exceed one year, or by both such fine and imprisonment. <br /> For purposes of this subsection A, "inflation" means the annual percentage change <br /> in the United States Department of Labor, Bureau of Labor Statistics, Consumer <br /> Price Index for Denver-Boulder, All Items, All Urban Consumers, or its successor <br /> index. <br /> Section 2. Section 5.18.290 of the Louisville Municipal Code is hereby amended to <br /> Ordinance No. 1645, Series 2013 <br /> Page 1 of 9 <br />
