<br />~01218730 09/10/92 03:04 PM REAL ESTATE RECORDS <br />F1758 CHARLOTTE HOUSTON BOULDER CNTY CO RECORDER <br /> <br />'1-/ <br /> <br />ORDINANCE NO. 1078 <br />SERIES 1992 <br /> <br />AN ORDINANCE AMENDING SECTIONS 9.46.030 AND 9.46.040 OF <br />CHAPTER 9.46 AND AMENDING SECTION 9.92.020 OF CHAPTER <br />9.92 OF THE LOUISVILLE MUNICIPAL CODE CONCERNING THEFT, <br />SHOPLIFTING, AND FRAUD BY CHECK OFFENSES. <br /> <br />WHEREAS, a recent law was passed by the Colorado legislature <br />changing the monetary amounts established for classification of <br />specific property crimes; and <br /> <br />WHEREAS, the City Council has determined that Sections <br />9.46.030, 9.46.040, and 9.92.020 of the Louisville Municipal Code <br />concerning theft, shoplifting, and fraud by check offenses are in <br />need of updating and amendment to be consistent with the recent <br />changes to state statutes. <br /> <br />o <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />section 1. Section 9.46.030 of the Louisville Municipal <br />Code is amended to read as follows (words to be deleted are <br />stricken through; words to be added appear in capital letters): <br /> <br />9.46.030 Theft. <br /> <br />It is unlawful for any person to knowingly obtain or <br />exercise control over any item or items of value of less <br />than three FOUR hundred dollars without authorization or <br />by threat or deception and who: <br /> <br />A. Intends to deprive the other person permanently of <br />the use or benefit of the thing of value; <br /> <br />B. Knowingly uses, conceals, or abandons the thing of <br />value in such manner as deprived the other person <br />permanently of its use or benefit; <br /> <br />C. Uses, conceals or abandons the thing of value <br />intending that such use, concealment or abandonment <br />will deprive the other person permanently of its <br />use and benefit; or <br /> <br />D. Demands any consideration to which it is not <br />legally entitled as a condition to restoring the <br />thing of value to the other person. <br /> <br />1 <br />
