ORDINANCE NO. 1648 <br /> SERIES 2013 <br /> AN ORDINANCE OF THE CITY OF LOUISVILLE AMENDING THE TEMPORARY <br /> MORATORIUM ON THE ESTABLISHMENT OR OPERATION OF RETAIL <br /> MARIJUANA ESTABLISHMENTS WITHIN THE CITY <br /> WHEREAS, on October 1, 2013, the City Council adopted Ordinance No. 1643, Series <br /> 2013, an emergency ordinance establishing a temporary moratorium on the establishment or <br /> operation of marijuana cultivation facilities, marijuana product manufacturing facilities, marijuana <br /> testing facilities, or retail marijuana stores (collectively, "retail marijuana establishments") within <br /> the City, which moratorium lasts until December 31, 2014; and <br /> WHEREAS, the purpose of the moratorium is to allow City Staff and the City Council the <br /> opportunity to study the issues, further develop regulations and recommendations pertaining to such <br /> businesses, and to review and consider referring to the City's registered electors the question of <br /> whether such businesses should be prohibited within the City; and <br /> WHEREAS, the moratorium, as drafted, applies to new businesses desiring to apply for <br /> retail marijuana licenses and existing medical marijuana businesses that wish to convert to retail <br /> marijuana establishments or to operate both a medical marijuana business and retail marijuana <br /> establishment in the same shared premises; and <br /> WHEREAS, the Colorado Retail Marijuana Code (codified at C.R.S. § 12-43.4-101) and <br /> the implementing regulations promulgated by the Department of Revenue include provisions <br /> allowing existing medical marijuana businesses in good standing to apply for retail marijuana <br /> licenses and to share their premises with retail marijuana establishments, unless prohibited by a <br /> local jurisdiction; and <br /> WHEREAS, the City Council desires to amend its temporary moratorium on retail <br /> marijuana establishments to allow existing medical marijuana businesses within the City to apply <br /> for retail marijuana licenses, subject to certain restrictions, including that any retail marijuana <br /> license obtained shall be subject to non-renewal in the event retail marijuana establishments are <br /> prohibited within the City through the enactment of an ordinance or by vote of the registered <br /> electors of the City, which prohibition shall constitute "good cause" for non-renewal of a license; <br /> and <br /> WHEREAS, the City Council further desires to extend the moratorium to marijuana <br /> businesses not specifically contemplated by Amendment 64; <br /> NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br /> OF LOUISVILLE, COLORADO: <br /> Section 1. The temporary moratorium on retail marijuana establishments established by <br /> Ordinance No. 1643, Series 2013 shall not apply to an existing medical marijuana business <br /> 1 <br />
