RESOLUTION NO. 21 <br />SERIES 2014 <br />A RESOLUTION APPROVING AN INTERGOVERMENTAL AGREEMENT WITH THE <br />COLORADO DEPARTMENT OF TRANSPORTATION FOR THE COUNTY ROAD <br />BRIDGE AND DILLON ROAD UNDERPASS FLOOD RECONSTRUCTION PROJECTS <br />WHEREAS, pursuant to federal law, the President of the United States declared certain <br />Colorado counties as disaster areas and available for federal assistance due to the flooding that <br />occurred in September 2013 and issued a "Presidential Declaration" in connection therewith; and <br />WHEREAS, pursuant to state law, the Colorado Governor also declared a disaster <br />emergency in certain Colorado counties due to the flooding that occurred in September 2013 and <br />issued the "Governor's Order" in connection therewith; and <br />WHEREAS, as a result of such flooding, transportation improvements within the City <br />including the County Road Bridge and Dillon Road Underpass were significantly damaged and <br />must be repaired and/or replaced; and <br />WHEREAS, pursuant to the "Presidential Declaration" and other federal law, including <br />without limitation the Emergency Relief Program for Federal -Aid Highways, federal funds have <br />been allocated for transportation projects requested by the State and local agencies; and <br />WHEREAS, pursuant to State law, including without limitation C.R.S. §§ 29 -1 -203; 43 -1- <br />110, 43 -1 -116, 43- 2- 101(4)(c) and 43 -2- 104.5, the Colorado Department of Transportation <br />( "CDOT ") and local agencies are authorized to contract for the funding for Program projects <br />performed by the local agency; and <br />WHEREAS, there has been proposed between CDOT and the City of Louisville a Master <br />Intergovernmental Agreement ( "IGA ") to provide for the disbursement of Federal and/or other <br />funds to the City pursuant to the "Presidential Declaration" and "Governor's Order" for funding <br />City transportation projects in the Program; and <br />WHEREAS, the City Council finds that the proposed IGA is in the best interests of the City <br />and its citizens, and by this resolution desires to approve the IGA, authorize its execution, and <br />authorize certain actions in connection therewith; <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />1. The City Council hereby approves that certain Master Intergovernmental <br />Agreement ( "IGA ") between the City of Louisville and the State of Colorado, acting by and <br />through the Colorado Department of Transportation ( "CDOT "), for disbursement of Federal <br />and/or other funds to the City pursuant to the "Presidential Declaration" and "Governor's Order," <br />for funding City transportation projects resulting from the September 2013 floods, in <br />substantially the same form of such IGA accompanying this Resolution ( "IGA "). <br />Resolution No. 21, Series 2014 <br />Page 1 of 2 <br />
