RESOLUTION NO. 21 SERIES 2014 A RESOLUTION APPROVING AN INTERGOVERMENTAL AGREEMENT WITH THE COLORADO DEPARTMENT OF TRANSPORTATION FOR THE COUNTY ROAD BRIDGE AND DILLON ROAD UNDERPASS FLOOD RECONSTRUCTION PROJECTS WHEREAS, pursuant to federal law, the President of the United States declared certain Colorado counties as disaster areas and available for federal assistance due to the flooding that occurred in September 2013 and issued a "Presidential Declaration" in connection therewith; and WHEREAS, pursuant to state law, the Colorado Governor also declared a disaster emergency in certain Colorado counties due to the flooding that occurred in September 2013 and issued the "Governor's Order" in connection therewith; and WHEREAS, as a result of such flooding, transportation improvements within the City including the County Road Bridge and Dillon Road Underpass were significantly damaged and must be repaired and/or replaced; and WHEREAS, pursuant to the "Presidential Declaration" and other federal law, including without limitation the Emergency Relief Program for Federal -Aid Highways, federal funds have been allocated for transportation projects requested by the State and local agencies; and WHEREAS, pursuant to State law, including without limitation C.R.S. §§ 29 -1 -203; 43 -1- 110, 43 -1 -116, 43- 2- 101(4)(c) and 43 -2- 104.5, the Colorado Department of Transportation ( "CDOT ") and local agencies are authorized to contract for the funding for Program projects performed by the local agency; and WHEREAS, there has been proposed between CDOT and the City of Louisville a Master Intergovernmental Agreement ( "IGA ") to provide for the disbursement of Federal and/or other funds to the City pursuant to the "Presidential Declaration" and "Governor's Order" for funding City transportation projects in the Program; and WHEREAS, the City Council finds that the proposed IGA is in the best interests of the City and its citizens, and by this resolution desires to approve the IGA, authorize its execution, and authorize certain actions in connection therewith; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: 1. The City Council hereby approves that certain Master Intergovernmental Agreement ( "IGA ") between the City of Louisville and the State of Colorado, acting by and through the Colorado Department of Transportation ( "CDOT "), for disbursement of Federal and/or other funds to the City pursuant to the "Presidential Declaration" and "Governor's Order," for funding City transportation projects resulting from the September 2013 floods, in substantially the same form of such IGA accompanying this Resolution ( "IGA ").
