ORDINANCE NO. 1675 <br />SERIES 2014 <br />AN ORDINANCE AMENDING CHAPTER 9.76 OF THE LOUISVILLE MUNICIPAL <br />CONCERNING PUBLIC CONSUMPTION OF MARIJUANA <br />WHEREAS, Article XVIII, § 16 of the Colorado Constitution, referred to as Amendment <br />64, was approved by Colorado voters in November 2012; and <br />WHEREAS, Amendment 64 legalized the private use of marijuana for persons twenty - <br />one years of age or older; and <br />WHEREAS, the City Council previously enacted Chapter 9.76 of the Louisville <br />Municipal Code, which among other things, prohibits the public consumption of marijuana; and <br />WHEREAS, the City Council desires to amend Chapter 9.76 to further delineate the <br />places in which marijuana consumption is prohibited; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. Section 9.76.010 (Definitions) of Louisville Municipal Code is hereby by <br />amended by the addition of the following definition, which definition shall be inserted in <br />alphabetical order in said Section: <br />Common area shall mean a lobby, hallway, elevator, restroom, or other area <br />where the public is likely to gather in close proximity. <br />Section 2. Section 9.76.030 of Louisville Municipal Code is hereby by amended to read <br />as follows (words to be deleted are strielen4hreugh; words to be added are underlined): <br />Sec. 9.76.030. Public consumption of marijuana prohibited. <br />A. It shall be unlawful for any person to consume or use marijuana in <br />any place that is commonly or usually open to the general public, being either public <br />or private property, and including but not limited to, parks, open space, trails, <br />sidewalks, streets, public rights -of -way, common areas and places of business open <br />to the general to which the public is invited in or in which the public is permitted. <br />For purposes of this Chapter, "places of business to which the public is invited in or <br />in which the public is permitted," shall include but not be limited to, retail food <br />production or marketing establishments, restaurants, taverns, banks, commercial <br />establishments, theatres, waiting rooms, reception areas, meeting rooms, educational <br />facilities, libraries, recreational facilities, health care facilities, facilities providing <br />live music or sporting events, and public transportation facilities. <br />Ordinance No. 1675, Series 2014 <br />Page 1 of 3 <br />
