ORDINANCE NO. 1737 <br />SERIES 2017 <br />AN ORDINANCE AMENDING CERTAIN PROVISIONS OF CHAPTER 3.18 OF THE <br />LOUISVILLE MUNICIPAL CODE AND ADOPTING AN UPDATED SCHEDULE OF <br />DEVELOPMENT IMPACT FEES FOR TRANSPORTATION CAPITAL FACILITIES, <br />LIBRARY CAPITAL FACILITIES, AND PARKS AND TRAILS CAPITAL FACILITIES <br />WHEREAS, the City Council of the City of Louisville, Colorado finds that: <br />A By Ordinance No 1506, Series 2006, the City Council repealed and re-enacted <br />Chapter 3.18 of the Louisville Municipal Code ("Code") regarding the establishment of <br />development Impact Fees, <br />B. Pursuant to an impact fee study conducted at the time of the adoption of <br />Ordinance No 1506, Series 2006, the City by said Ordinance established development <br />Impact Fees for Municipal Capital Facilities, Library Capital Facilities, Transportation <br />Capital Facilities, Parks and Trails Capital Facilities, and Recreation Capital Facilities; <br />C. Section 3.18.100 of the Code provides that the Impact Fees described in Chapter <br />3.18 shall be reviewed at least once every five years to, among other things, ensure that <br />the demand and cost assumptions underlying the Impact Fees are still valid, and that the <br />resulting Impact Fees do not exceed the actual costs of constructing Capital Facilities that <br />are of the type for which the fees are paid and that are required to serve new impact - <br />generating development; <br />D. In 2011, as part of its five-year review under Section 3.18 100 of the Code, and in <br />order to continue to implement an equitable impact fee system, the City prepared an <br />impact fee study entitled City of Louisville, Colorado Impact Fees dated August 25, 2011 <br />("2011 Study"), and adopted Ordinance No. 1602, Series 2011, adopting revised Impact <br />Fees consistent with the 2011 Study, <br />E. In 2016, as part of its five-year review under Section 3 18 100 of the Code, and in <br />order to continue to implement an equitable impact fee system, the City appointed an <br />Impact Fee Liaison Committee to review the City's Impact Fees, and as part of such <br />review there was commissioned and has been prepared an impact fee study entitled City <br />of Louisville, Colorado Development Impact Fee Study dated Apnl 18, 2017 ("Impact <br />Fee Study"); <br />F. The Impact Fee Study finds that new development in the City is placing and is <br />projected to place an increased demand upon the City's Transportation Capital Facilities, <br />Library Capital Facilities, and Parks and Trails Capital Facilities, <br />Ordinance No 1737, Series 2017 <br />Page 1 of 10 <br />
