ORDINANCE NO 1766 <br />SERIES 2018 <br />AN ORDINANCE AMENDING CHAPTER 8.64 OF THE LOUISVILLE MUNICIPAL <br />CODE, ENTITLED "RESIDENTIAL REFUSE AND RECYCLING COLLECTION," TO <br />AMEND AND ADD PROVISIONS REGARDING COLLECTION OF COMPOSTABLE <br />MATERIALS, TO ADD HAULER LICENSING AND REPORTING REQUIREMENTS, <br />AND TO MAKE OTHER AMENDMENTS TO SAID CHAPTER 8.64 <br />WHEREAS, the City of Louisville ("City") is a home rule municipal corporation, duly <br />organized and existing pursuant to the Louisville Home Rule Charter ("Charter"); and <br />WHEREAS, pursuant to Section 30-15-401, C.R.S., the City is authonzed to provide <br />residential refuse services for the collection and transportation of ashes, trash, rubbish, garbage, or <br />any other discarded materials, including without limitation any such material which is recyclable <br />or compostable, and to impose fees for such services except that the City may not compel industrial <br />or commercial establishments or multifamily residences of eight or more units to use or pay fees <br />for City -provided refuse services, and by Section 8 64 070 of the Louisville Municipal Code, the <br />City has further exempted homeowners' associations, and <br />WHEREAS, the City has previously established provisions for City residential refuse, <br />recycling and compostable materials collection services, and has established regulations regarding <br />same in Chapter 8 64 of the Louisville Municipal Code; and <br />WHEREAS, the City is empowered by its Charter and the Colorado Constitution and state <br />law, including without limitation C.R.S sections 31-15-401 et seq and 31-15-501 et seq., to <br />require licensing of persons or companies that provide the collection, transportation and/or <br />disposal of refuse, recycling or compostable materials, and <br />WHEREAS, the City is further empowered by its Charter and the Colorado Constitution <br />and state law, including without limitation C.R.S sections 31-15-401 et seq and 31-15-501 et seq., <br />to regulate the collection, transportation and/or disposal of refuse, recycling and compostable <br />materials; and <br />WHEREAS, the City desires to encourage waste reduction in order to further the waste <br />diversion goals supported by the City; and <br />WHEREAS, in furtherance of such goals, the City Council desires to make certain <br />amendments to Chapter 8 64 of the Louisville Municipal Code, and it is the intent of such <br />amendments to (1) reduce the volume of waste, recyclables and compostables entering the waste <br />stream and landfills, (2) encourage the recycling and composting of certain discarded materials; <br />(3) obtain information for the tracking and planning of waste diversion, and (4) protect and further <br />the health, safety and welfare of the public; <br />NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO• <br />Ordinance No. 1766, Series 2018 <br />Page 1 of 9 <br />
