ORDINANCE NO. 1545 SERIES 2008 AN ORDINANCE ENACTING A NEW CHAPTER 8.64 OF THE LOUISVILLE MUNICIPAL CODE CONCERNING RESIDENTIAL REFUSE AND SINGLE-STREAM RECYCLING COLLECTION SERVICES AND IMPOSING FEES FOR SUCH SERVICES WHEREAS, pursuant to Section 30-15-401, C.R.S., the City is authorized to provide residential refuse services for the collection and transportation of ashes, trash, rubbish, garbage, or any other discarded materials and to impose fees for such services except that the City may not compel industrial or commercial establishments or multifamily residences of eight or more units to use or pay fees for City-provided refuse services; and WHEREAS, City Council finds that providing residential refuse services is in the public interest for a number of reasons, including without limitation, the overall costs of refuse services may be reduced, wear and tear on streets caused by a multiplicity of refuse trucks may be reduced, and the quality of life of City residents and public safety are benefited by not having multiple refuse haulers operating within the City; and WHEREAS, the City has complied with the statutory requirements to provide residential refuse services and to impose fees for such services; and WHEREAS, in recognition of the desires of the community, as evidenced by the 2008 citizen survey, the City Council is committed to a City refuse and recycling services program, and the City Council finds that implementing a residential single-stream recycling program in conjunction with the City's collection of refuse may increase the recycling of household goods; and WHEREAS,the City Council intends that the City's refuse and recycling services program be self-supporting and finds that it is necessary to impose fees for such services; and WHEREAS, the City Council finds that in order to ensure sanitary practices in the collection of refuse and recyclables that the City's billing, payment and enforcement practices for such service be similar to those for the City's water services, but that disconnection of water service shall not be available for non-payment of refuse and recycling services fees; and WHEREAS, the City Council desires to enact a new Chapter 8.64 of the Louisville Municipal Code concerning residential refuse and recycling services within the City and imposing fees for such services; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. Title 8 of the Louisville Municipal Code is hereby amended by the addition of a new Chapter 8.64 to read as follows: 1
