IYII IKII~YIII I~INMVIII%N lf~l ~^n 29929v95 ORDINANCE NO. 1547 SERIES 2009 AN ORDINANCE APPROVING THE VACATION OF A TEMPORARY SECONDARY EMERGENCY VEHICLE ACCESS EASEMENT AND TEMPORARY BIKE PATH EASEMENTS LOCATED WITHIN LOTS 2, 3, 4, AND 6, BLOCK 4, AND LOT 8, BLOCK 5, SPRUCE LANE SUBDIVISION WITHIN THE CITY OF LOUISVILLE. WHEREAS, by the Spruce Lane Subdivision Plat recorded in the Office of the Boulder County Clerk and Recorder on September 22, 1987 at Reception No. 00878399, Plan File P-21, F-2, #42-#43, there was dedicated to the City of Louisville an easement for temporary secondary emergency vehicle access purposes and a 15-foot temporary bike path easement over portions of Lots 2, 3, 4, and 6, Block 4, and Lot 8, Block 5, Spruce Lane Subdivision, in the City of Louisville, County of Boulder, State of Colorado; and WHEREAS, by a Grant of Easement and Right-of--Way recorded in the Office of the Boulder County Clerk and Recorder on February 18, 1994, at Reception No. 0139664, there was granted to the City a temporary bike path easement over a portion of Lot 6, Block 4, Spruce Lane Subdivision; and WHEREAS, by a Grant of Easement and Right-of--Way recorded in the Office of the Boulder County Clerk and Recorder on February 18, 1994, at Reception No. 0139665, there was granted to the City a temporary bike path easement over a portion of Lot 8, Block 5, Spruce Lane Subdivision; and WHEREAS, the purpose of such emergency vehicle access easement was to provide temporary emergency access until the installation of West Walnut Street was completed, and the purpose of each of the temporary bike path easements was to provide temporary bike access until a permanent bike path was located and installed; and WHEREAS, application has been made to the City for vacation of the temporary secondary emergency vehicle access easement and the temporary bike path easements; and WHEREAS, the Louisville Fire Protection District has determined that the temporary secondary emergency vehicle access easement is no longer necessary to provide secondary emergency access to the Spruce Lane Subdivision; and WHEREAS, the City Council has determined that the temporary secondary emergency vehicle access easement and the temporary bike path easements for which vacation is requested are not and will not be needed for any public purposes; and WHEREAS, the City Council has determined that the temporary secondary emergency vehicle access easement and the temporary bike path easements for which vacation is requested are not being used or held for park purposes or for any other governmental purposes; and C' .oL ~-id~7
