IYII IKII~YIII I~INMVIII%N lf~l ~^n 29929v95 <br />ORDINANCE NO. 1547 <br />SERIES 2009 <br />AN ORDINANCE APPROVING THE VACATION OF A TEMPORARY SECONDARY <br />EMERGENCY VEHICLE ACCESS EASEMENT AND TEMPORARY BIKE PATH <br />EASEMENTS LOCATED WITHIN LOTS 2, 3, 4, AND 6, BLOCK 4, AND LOT 8, BLOCK <br />5, SPRUCE LANE SUBDIVISION WITHIN THE CITY OF LOUISVILLE. <br />WHEREAS, by the Spruce Lane Subdivision Plat recorded in the Office of the Boulder <br />County Clerk and Recorder on September 22, 1987 at Reception No. 00878399, Plan File P-21, F-2, <br />#42-#43, there was dedicated to the City of Louisville an easement for temporary secondary <br />emergency vehicle access purposes and a 15-foot temporary bike path easement over portions of <br />Lots 2, 3, 4, and 6, Block 4, and Lot 8, Block 5, Spruce Lane Subdivision, in the City of Louisville, <br />County of Boulder, State of Colorado; and <br />WHEREAS, by a Grant of Easement and Right-of--Way recorded in the Office of the <br />Boulder County Clerk and Recorder on February 18, 1994, at Reception No. 0139664, there was <br />granted to the City a temporary bike path easement over a portion of Lot 6, Block 4, Spruce Lane <br />Subdivision; and <br />WHEREAS, by a Grant of Easement and Right-of--Way recorded in the Office of the <br />Boulder County Clerk and Recorder on February 18, 1994, at Reception No. 0139665, there was <br />granted to the City a temporary bike path easement over a portion of Lot 8, Block 5, Spruce Lane <br />Subdivision; and <br />WHEREAS, the purpose of such emergency vehicle access easement was to provide <br />temporary emergency access until the installation of West Walnut Street was completed, and the <br />purpose of each of the temporary bike path easements was to provide temporary bike access until a <br />permanent bike path was located and installed; and <br />WHEREAS, application has been made to the City for vacation of the temporary secondary <br />emergency vehicle access easement and the temporary bike path easements; and <br />WHEREAS, the Louisville Fire Protection District has determined that the temporary <br />secondary emergency vehicle access easement is no longer necessary to provide secondary <br />emergency access to the Spruce Lane Subdivision; and <br />WHEREAS, the City Council has determined that the temporary secondary emergency <br />vehicle access easement and the temporary bike path easements for which vacation is requested are <br />not and will not be needed for any public purposes; and <br />WHEREAS, the City Council has determined that the temporary secondary emergency <br />vehicle access easement and the temporary bike path easements for which vacation is requested are <br />not being used or held for park purposes or for any other governmental purposes; and <br />C' .oL ~-id~7 <br />
