2220 Page17 <br />: 1 of 158 <br />I I <br />I I <br />i <br />I I I <br />I I <br />i <br />I II <br />I I <br />ou der County Clerk, CO ORD <br />ORDINANCE NO. 1364 <br />SERIES 2001 <br />H <br />i <br />11/21/2001 11:43A <br />R 90.00 D 0.00 <br />AN ORDINANCE APPROVING AN AMENDMENT TO AN <br />INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF <br />LOUISVILLE AND THE COUNTY OF BOULDER, COLORADO, AND <br />AUTHORIZING THE CONVEYANCE OF CERTAIN PARCELS OF REAL <br />ESTATE IN CONNENCTION WITH SUCH AMENDMENT <br />WHEREAS, the City of Louisville and the County of Boulder are parties to an <br />Intergovernmental Agreement dated June 17, 1999 and recorded August 3, 1999 at Reception <br />No. 1967531 (the "City/County IGA"), which IGA concerns the purchase and sale of certain <br />parcels of land commonly referred to Trillium and Boulder County Land Venture open space <br />parcels located at the northeast and southwest corners of the intersection of Dillon Road and <br />South 104th Street (the "Properties"); and <br />WHEREAS, excluded from the Properties is the original alignment of the Northwest <br />Parkway, which alignment was set forth in the February 18, 1999 Intergovernmental Agreement <br />among the City of Louisville, City of Lafayette, City of Broomfield, and County of Boulder entitled <br />Southeast Boulder County, South 96th Street, Dillon Road, and U.S. 287 Area Comprehensive <br />Development Plan (the "Northwest Parkway IGA"), and which original alignment is described in <br />Exhibit A to the instrument accompanying this Ordinance; and <br />WHEREAS, pursuant to the City/County IGA, the City has acquired certain portions of <br />the Properties, and the parties intend to exchange additional deeds and conservations easements <br />so that the City and County become owners of undivided one-half interests in the Properties, <br />excluding the Northwest Parkway alignment, and the grantees of conservation easements over <br />such Properties, excluding the Northwest Parkway alignment; and <br />WHEREAS, for the preservation of wetlands area, the alignment of the Northwest Parkway <br />was modified in the January 16, 2001, Intergovernmental Agreement among the City of Louisville, <br />City of Lafayette, City of Broomfield, County of Boulder, and Northwest Parkway Public Highway <br />Authority (the "PHA"), and the new alignment is described and depicted on Exhibit B to the <br />instrument accompanying this Ordinance; and <br />WHEREAS, an amendment to the City/County IGA has been proposed to provide for <br />certain conveyances and other transactions necessary to modify the alignment of the Northwest <br />Parkway; and <br />WHEREAS, as part of such amendment and realignment of the Northwest Parkway, it is <br />proposed that the City convey certain portions of the Properties necessary for the new alignment of <br />the Northwest Parkway in exchange for conveyance to the City of undivided one-half interests in <br />
