RESOLUTION NO. 23 <br />SERIES 2023 <br />A RESOLUTION SUPPORTING STATEWIDE EFFORTS AND COOPERATION TO <br />SUPPORT AFFORDABLE HOUSING WITHOUT IMPOSING THE STATEWIDE LAND <br />USE AND ZONING PREEMPTIONS IN SENATE BILL 23-213 <br />WHEREAS, for a century, the State of Colorado has committed both in statute and in <br />the state constitution to the local control of land use planning and zoning because local <br />governments are closest to the land and to the people that occupy it; and <br />WHEREAS, zoning and land use cannot be viewed separately from the impacts of <br />proposed uses of land on surrounding properties and a community as a whole, including the <br />ability to ensure adequate water and utilities; to provide enough public safety services, <br />schools, and recreational services; to make sure that sufficient and safe infrastructure is <br />available to handle increased population or more intense uses; to align development with <br />the community's economic goals; to prevent displacement of existing people; to preserve <br />important historical sites; and to protect open space and the environment in general; and <br />WHEREAS, the City Council is committed to increasing the amount of affordable <br />housing within the City, which it finds to be integral to its efforts toward equity, diversity, and <br />inclusion within the community; and <br />WHEREAS, the City is currently undergoing a comprehensive plan update and a <br />housing study to identify the best ways the City of Louisville can facilitate affordable through <br />its ordinances and other regulatory means; and <br />WHEREAS, the City Council finds that the intentions behind Senate Bill 23-213 are <br />good, and the goals of the Bill are laudable and shared by the City, but the requirements in <br />the Bill would place statewide mandates on local land use matters and substitute the <br />judgment of legislators and state regulators who lack the understanding needed to make the <br />right decisions for our particular community; and <br />WHEREAS, the City Council further finds the impact of the Marshall Fire, and current <br />rebuilding efforts by those whose homes were damaged or destroyed by the Marshall Fire, <br />require unique considerations with the City's land use and planning, underscoring the <br />necessity of tailoring affordable housing requirements to the particular needs and <br />circumstances of our City and its residents; and <br />WHEREAS, Senate Bill 23-213 will impact the City's long-range planning efforts and <br />limit the City's ability to maintain reasonable zoning regulations to ensure a high quality of life <br />and sound economic environment for our current and future residents, workers, and <br />business owners; and <br />Resolution No. 23, Series 2023 <br />Page 1 of 2 <br />
