RESOLUTION NO. 22 <br />SERIES 2000 <br /> <br /> A RESOLUTION APPROVING AN <br />AMENDED FINAL PUD DEVELOPMENT PLAN <br />AND MINOR SUBDIVISION REPLAT FOR <br /> THE BELLA VISTA SOUTH SUBDIVISION <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council, a request for approval <br />of an Amended Final PUD Development Plan and Minor Subdivision Replat for the Bella Vista <br />South subdivision; and <br /> <br /> WHEREAS, all materials related to the Amended Final PUD Development Plan and Minor <br />Replat have been reviewed by City Staff and the Planning Commission and found, with conditions, <br />to be in compliance with the Louisville zoning ordinances, subdivision regulations, applicable design <br />standards, related policies and previous approvals; and <br /> <br /> WHEREAS, after a duly noticed public hearing concerning said Amended Final PUD <br />Development Plan and minor subdivision replat, the Planning Commission recommended approval <br />to the City Council, with conditions; and <br /> <br /> WHEREAS, the applicant has agreed to comply with all recommended Planning <br />Commission conditions and City Council finds that said Amended Final PUD Development Plan <br />& minor subdivision replat should be approved, with the following conditions: <br /> <br />That Outlot 'A' shall be conveyed to the City by Special Warranty Deed in a form acceptable <br />to the City. An ALTA title policy shall be required. <br /> <br />A shared access easement for the shared driveway to Lots 1 & 2 shall be noted (to scale) on <br />the PUD prior to recording and that easement and agreement shall be subject to Staff review <br />and approval. Recording data for the instrument shall be noted on the PUD. <br /> <br />That a current, certified real estate appraisal of the entire site shall be provided to the City to <br />determine the amount of the fee in-lieu of land dedication. The appraisal shall be prepared <br />and dated no later than two months prior to the time of payment and shall reflect the value of <br />the property including all subdivision improvements, and that the fee shall be paid prior to <br />recording the replat and/or amended PUD. <br /> <br />An amendment to the Amended Bella Vista South Subdivision Agreement shall be executed <br />prior to recordation of the replat and/or Amended PUD in the form of such amendment <br />accompanying this Resolution. <br /> <br /> <br />
