<br />ORDINANCE NO. 1570 <br />SERIES 2010 <br /> <br />AN EMERGENCY ORDINANCE OF THE CITY OF LOUISVILLE AMENDING <br />ORDINANCE NO. 1561 TO EXTEND THE TEMPORARY MORATORIUM ON THE <br />ACCEPTANCE, PROCESSING, OR ISSUANCE OF APPLICATIONS OR REQUESTS <br />FOR BUSINESS REGISTRATION, SALES TAX LICENSES, BUILDING PERMITS, AND <br />CERTIFICATES OF OCCUPANCY FOR MEDICAL MARIJUANA DISPENSARIES <br />WITHIN THE CITY OF LOUISVILLE <br /> <br />WHEREAS, the City of Louisville adopted Ordinance No. 1561, Series 2009, on October <br />20, 2009, which established a temporary moratorium until May 15, 2010 on the acceptance, <br />processing, or issuance of applications or requests for business registration, sales tax licenses, <br />building permits, and certificates of occupancy for medical marijuana dispensaries within the City <br />of Louisville; and <br /> <br />WHEREAS, the Colorado Legislature is currently considering legislation clarifying issues <br />related to medical marijuana dispens.aries, and the City Council desires for it and City staff to have <br />the opportunity to review such legislation if enacted and the impact that such legislation may have <br />on the City, as a home-rule municipality, to regulate such dispensaries; and <br /> <br />WHEREAS, the City Council finds that extending the moratorium enacted by Ordinance <br />No. 1561 for an additional three months from its original expiration will allow City staff and City <br />Council additional time to investigate the City's ability to regulate medical marijuana dispensaries <br />and to develop and implement any appropriate regulations consistent with state law; and <br /> <br />WHEREAS, the City Council finds and determines that it is necessary and appropriate to <br />extend the temporary moratorium on accepting, reviewing, approving, or otherwise acting upon <br />applications or requests for business registration, sales tax licenses, building permits, and <br />certificates of occupancy for medical marijuana dispensaries for an additional three months; <br /> <br />NOW, THEREFORE, HE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. Section 2 of Ordinance No. 1561, Series 2009 is hereby amended to delete <br />the phrase "May 15, 2010" and insert "August 15,2010" in its place. <br /> <br />Section 2. Section 4 of Ordinance No. 1561, Series 2009 is hereby amended to delete <br />the phrase "May 15, 2010" and insert "August 15,2010" in its place. <br /> <br />Section 3. If any portion of this ordinance is held to be invalid for any reason, such <br />decision shall not affect the validity of the remaining portions of this ordinance. The City Council <br />hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact <br />that anyone part be declared invalid. <br /> <br />1 <br />
