ORDINANCE NO. 1605 <br /> SERIES 2011 <br /> AN ORDINANCE AMENDING SECTION 17.12.050 OF THE LOUISVILLE <br /> MUNICIPAL CODE TO ALLOW ADDITIONS TO CONTINUE EXISTING ROOF <br /> PITCHES ON LEGAL NON-CONFORMING STRUCTURES IN THE OLD TOWN <br /> OVERLAY DISTRICT AND ADDING SECTION 17.08.413 TO THE LOUISVILLE <br /> MUNICIPAL CODE TO DEFINE ROOF PITCH <br /> WHEREAS,the City of Louisville is a home rule municipal corporation organized under <br /> and pursuant to Article XX of the Colorado Constitution and the Louisville Home Rule Charter; <br /> and <br /> WHEREAS, the City has previously established the Old Town Overlay District (the <br /> District) and specific regulations for properties located within the District; and <br /> WHEREAS, Subsection C of Section 17.12.050 of the Louisville Municipal Code <br /> (LMC) contains specific regulations with regards to design and slope of roofs in the District; and <br /> WHEREAS, City staff,the design community, and owners subject to the requirements of <br /> Subsection 17.12.050.0 of the LMC have found the requirements therein to be overly restrictive <br /> in cases where additions are proposed to structures that are legal non-conforming with regards to <br /> roof design and slope; and <br /> WHEREAS, Subsection 17.12.050.0 of the LMC currently requires all homes and <br /> additions in the Old Town Overlay District, regardless of any historic qualities, to have a roof <br /> pitch of 6:12 or greater; and <br /> WHEREAS, there are many legal non-conforming structures with regards to roof pitch, <br /> often with historic value, in the Old Town Overlay District which contribute to the character and <br /> historic qualities of the City; and <br /> WHEREAS, currently, any homeowner wishing to construct an addition in the Old <br /> Town Overlay District to a legal non-conforming structure with less than a 6:12 roof pitch must <br /> apply for a variance; and <br /> WHEREAS, it will be beneficial to the City and its historic character to allow homes <br /> with legal non-conforming roofs to make additions and continue the existing roof pitch without <br /> needing to obtain a variance; and <br /> WHEREAS, the definition of roof pitch is currently provided in the Yard and Bulk <br /> Requirements section of title 17 of the LMC, and should instead be located in the Definitions <br /> section; and <br /> WHEREAS, after a duly noticed public hearing held October 13, 2011, where evidence <br /> and testimony were entered into the record, including the findings in the Louisville Planning <br /> Ordinance 1605, Series 2011 <br /> Page 1 of 3 <br />
