RESOLUTION NO. 5 <br />SERIES 2017 <br />A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT WITH <br />THE TOWN OF SUPERIOR REGARDING HOURS OF CONSTRUCTION WORK ON <br />McCASLIN BOULEVARD <br />WHEREAS, McCaslm Boulevard runs through both the City of Louisville and the Town <br />of Superior, and carries significant traffic and provides access to U S Highway 36 and multiple <br />commercial areas, and <br />WHEREAS, disruption of traffic on McCaslin Boulevard by construction activities <br />negatively impacts both the City and the Town, and <br />WHEREAS, m the spirit of cooperation and to minimize negative traffic impacts, the <br />City and Town desire to agree to limit the hours of road construction work on McCaslin <br />Boulevard, and an mtergovemmental agreement has been proposed for such purposes, and <br />WHEREAS, the City and Town are authonzed to enter mto the agreement pursuant to state <br />law, mcludmg but not limited to C R S § 29-1-203, and the City Council by this Resolution desires <br />to approve said agreement and authonze its execution, <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />1 The Proposed Intergovernmental Agreement between the City of Louisville and the <br />Town of Superior concerning construction the hours of construction work on McCaslm Boulevard <br />(the "IGA") is hereby approved m essentially the same form as the copy of such IGA accompanying <br />this Resolution <br />2 The Mayor is authonzed to execute the IGA on behalf of the City, except that the <br />Mayor is hereby further granted authonty to negotiate and approve such revisions to said IGA as the <br />Mayor determines are necessary or desirable for the protection of the City, so long as the essential <br />terms and conditions of the IGA are not altered. <br />3 The Mayor, City Manager, Director of Public Works and City staff are hereby <br />authonzed to execute all documents and do all other things necessary on behalf of the City to <br />perform the obligations of the City under the IGA <br />PASSED AND ADOPTED this 7th day of February, 2017 <br />ARREST <br />-(11/ <br />Robert P.
