ORDINANCE NO. 1289 <br />SERIES 1998 <br /> <br />AN ORDINANCE DESIGNATING THE SITE SELECTION OF ARTERIAL HIGHWAYS <br />AND INTERCHANGES AND COLLECTOR HIGHWAYS AS AN ACTIVITY OF STATE <br />INTEREST; DESIGNATING AREAS AROUND ARTERIAL HIGHWAY INTERCHANGES <br />AS AREAS OF STATE INTEREST; ADOPTING REGULATIONS FOR THE <br />ADMINISTRATION OF SUCH AREAS AND ACTIVITIES OF STATE INTEREST; AND <br />AMENDING CHAPTER 17.32 OF THE LOUISVILLE MUNICIPAL CODE TO ADOPT <br />AMENDED REGULATIONS FOR THE ADMINISTRATION OF AREAS AND <br />ACTIVITIES OF STATE INTEREST, PURSUANT TO ARTICLE 65.1 OF TITLE 24, <br />COLORADO REVISED STATUTES. <br /> <br /> WHEREAS, pursuant to C.R.S. §§24-65.1-101 et seq. ("House Bill 1041"), the City is <br />authorized to designate areas and activities of state interest, and to adopt guidelines and regulations <br />for the administration of such areas and activities of state interest; and <br /> <br /> WHEREAS, pursuant to House Bill 1041, the City has previously adopted general <br />administrative regulations concerning areas and activities of state interest, which regulations are <br />contained in Chapter 17.32 of the Louisville Municipal Code; and <br /> <br /> WHEREAS, pursuant to Ordinance Nos. 501 and 507, Series 1976, the City previously <br />designated certain geologic hazard areas as areas of state interest and adopted regulations for the <br />administration of such areas; and <br /> <br /> WHEREAS, pursuant to House Bill 1041, the City desires to designate as an activity of state <br />interest the site selection of arterial highways and interchanges and collector highways, and to <br />designate as an area of state interest areas around arterial highway interchanges; and <br /> <br /> WHEREAS, pursuant to House Bill 1041, the City desires to adopt regulations for the <br />administration of such areas and activities of state interest, and to amend the general administrative <br />regulations for matters of state interest that are currently contained in Chapter 17.32 of the Louisville <br />Municipal Code; and <br /> <br /> WHEREAS, at a public heating held on November 17, 1998 ("the Public Hearing"), the City <br />Council considered this Ordinance to designate as an activity of state interest the site selection of <br />arterial highways and interchanges and collector highways; to designate as an area of state interest <br />areas around arterial highway interchanges; to adopt regulations for their administration; and to adopt <br />amendments to Chapter 17.32 of the Louisville Municipal Code to adopt and amend regulations for <br />the administration of areas and activities of state interest ("the Proposed 1041 Amendment"). <br /> <br /> WHEREAS, on November 10, 1998, the Louisville Planning Commission ("the Planning <br />Commission") held a public hearing to consider the Proposed 1041 Amendments, and recommended <br /> <br /> <br />
