RESOLUTION NO.4 SERIES 2022 A RESOLUTION WAIVING BUILDING PERMIT FEES FOR DEMOLITION OF STRUCTURES DAMAGED OR DESTROYED BY THE MARSHALL FIRE WHEREAS, on December 30, 2021, the Marshall Fire ignited in Boulder County and quickly spread to the City of Louisville, resulting in severe damage or total loss of almost six hundred (600) structures within the City of Louisville, most of them residential homes; and WHEREAS, also on December 30, 2021, the Mayor of the City of Louisville, pursuant to Chapter 2.32 of the Louisville Municipal Code and C.R.S. § 24-33.5-709, executed a Declaration of Local Disaster Emergency in and for the City of Louisville, which Disaster Declaration was thereafter continued in effect by resolution of the City Council, and the Governor of the State of Colorado issued a Declaration of Statewide Emergency in response to the Marshall Fire; and WHEREAS, on January 1, 2022, President Joseph R. Biden approved a Major Disaster Declaration for the Event (DR-4634-CO) beginning on December 30, 2021 and continuing thereafter; and WHEREAS, the destruction left by the Marshall Fire includes unprecedented amounts of debris that will need to be removed before rebuilding and other restoration efforts may commence; and WHEREAS, the soot and ash from structure fires may be toxic and contain carcinogens, making it imperative that such debris be disposed of in a timely and proper manner to mitigate risks to public health and safety; and WHEREAS, under the authority conferred by the Disaster Declaration and Section 2.32.020.0 of the Louisville Municipal Code, the City Manager entered into an Intergovernmental Agreement for the Provision of Assistance for Debris Removal resulting from the Colorado Wildfires and Straight -Line Winds Disaster (DR-4653-C) with Boulder County (the "Debris Removal IGA"; and WHEREAS, pursuant to the Debris Removal IGA, Boulder County will conduct debris removal on properties damaged or destroyed by the Marshall Fire unless property owners decline ("opt -out"); and WHEREAS, a City demolition permit is not required in connection with Boulder County's work under the Debris Removal IGA because all such work will be conducted and supervised by Boulder County, and will require no oversight by the City; and WHEREAS, property owners who opt -out of debris removal by Boulder County must obtain a City permit before demolition may be undertaken; and Resolution No. 4, Series 2022 Page 1 of 2
