<br /> City Council <br /> Meeting Minutes <br /> January 17, 2006 <br /> Page 1 0 of 11 <br /> LIBRARY UPDATE <br />Deputy City Manager Boyd updated Council on the progress of the new library <br />project, which continues to be under budget. The plumbing, electrical and <br />mechanical rough-ins on first and second floors has begun. Masonry on the west <br />elevation continues and the roof has been installed. The project is expected to <br />remain on schedule, with completion scheduled for June 8. Following the move- <br />in, the new building may be open to the public by August 1, 2006. <br /> CITY ATTORNEY'S REPORT <br />No items to report. <br /> CITY MANAGER'S REPORT <br />City Manager Simmons reported on the following: <br />. Itinerary for the City facility tour scheduled for Friday, January 20, 2006. <br />. The Interchange Committee will meet Wednesday, January 18, 2006. <br />. January 24, 2006 Study Session Agenda Item - Comprehensive Plan. <br />City Manager Simmons reminded Council the negotiation strategy with ComCast <br />for the Franchise Agreement has been well known. He referred to the June 6, <br />2005 Memorandum to Council where seventeen points were issued including <br />(PEG) Public, Education and Government access. Additionally, PEG channels <br />were discussed at the November 22,2005 Council Study Session meeting. With <br />respect to the enforcement language in the current franchise agreement, <br />Simmons explained it can be interpreted in different ways. Both the City Attorney <br />and Special Counsel have reviewed the language and believe the City may not <br />prevail in an action against Comcast. He stressed Public Access TV is <br />considered an integral, and important part of the negotiation strategy. <br />Mayor Pro Tern Brown inquired about an incident occurring on January 10, 2006. <br />City Manager Simmons did not know the particulars of that incident. Comcast <br />has committed to opening the studio only certain hours throughout the week, and <br />will post rules and regulations in the facility. He stated Comcast had issues with <br />unsupervised children in the studio. <br />Mayor Pro Tem Brown asked City Attorney Light about the merits of an <br />ordinance suggested by Mr. Luallin. <br />City Attorney Light explained the City's authority in the cable television area is <br />limited to what federal law allows. An ordinance may emphasize an important <br />point in a franchise agreement, but could not ask for more than what the federal <br />
