City Council Meeting Minutes February 21, 2006 Page 7 of 13 Denise Erhmann, 221 Front Street, Louisville, CO stated their request was for a 4-foot chain link fence, but the City added a provision of the 6-foot fence. She noted her home is 100 years old and she had no intention of enlarging it. She explained she would purchase the plaque in memory of her grandparents. MOTION: Mayor Sisk moved for approval of Resolution No.6, Series 2006, with the provision the fencing could not exceed 4-feet, and the quit claim deed confine the properties to their present size. Mayor Pro Tem Brown seconded the motion. Council member Muckle asked for clarification on the status of the resolution and ordinance. City Attorney Light explained the resolution would approve the settlement agreement. The ordinance would be brought back, for second reading, with the requested revisions, providing the counter proposal is acceptable to the Sawyers and the Ehrmanns. VOTE: Roll call vote was taken. The motion carried by a vote of 7-0. ORDINANCE NO. 1487, SERIES 2006 - AN ORDINANCE APPROVING THE VACATION OF PORTIONS OF THE SOUTH FRONT STREET RIGHT-OF-WAY LOCATED BETWEEN LOTS 16 AND 17, BLOCK 8 AND LOTS 10 AND 11, BLOCK 9 IN THE MURPHY PLACE SUBDIVISION IN THE CITY OF LOUISVILLE; AUTHORIZING THE EXECUTION OF QUIT CLAIM DEEDS IN CONNECTION WITH SUCH VACATION, AND APPROVING AND AUTHORIZING THE EXECUTION OF A GRANT OF EASEMENTS AND AGREEMENT FOR TEMPORARY OCCUPANCY OF THAT PORTION OF SUCH RIGHT-OF-WAY NOT SUBJECT TO VACATION _1ST READING - SET PUBLIC HEARING 3/7/06 MOTION: Mayor Pro Tem Brown moved that Ordinance No. 1487, Series 2006 be sent out for publication and a public hearing be set for March 7, 2006, seconded by Council member Sackett.
