<br /> City Council <br /> Meeting Minutes <br /> February 21, 2006 <br /> Page 9 of 13 <br /> ORDINANCE No. 1485, SERIES 2006 - AN ORDINANCE APPROVING THE <br /> VACATION OF A 10-FOOT BY 125-FOOT ALLEY RIGHT-OF-WAY LYING <br /> BETWEEN LOT 19, BLOCK 6 AND LOTS 20-24, BLOCK 6, JEFFERSON <br /> PLACE SUBDIVISION IN THE CITY OF LOUISVILLE - 2nd reading - public <br /> hearing (advertised Daily Camera 2/11/06) <br /> Mayor Sisk requested a City Attorney introduction. <br /> City Attorney Light read Ordinance No. 1485, Series 2006. <br /> Mayor Sisk requested a Staff presentation. <br /> Planning Director Wood explained the requested alley vacation is located south <br /> 720 Jefferson Avenue and north of properties at 701 and 717 Pine Street. The <br /> property owner at 720 Jefferson initiated the application however the two Pine <br /> Street property owners also support the request. <br /> The alley was dedicated to the City on the Jefferson Place subdivision plat, <br /> approved and recorded in October 1880. The alley is unpaved and platted at a <br /> width of 10 feet, which is smaller than downtown area's primary alleys, which <br /> were platted at a 20 feet width. The smaller alleys were dedicated for service <br /> and utility access, and given their width, have not proved useful for vehicular <br /> access. The alley functions as a utility corridor for overhead and underground <br /> public and private utilities. <br /> Because the east-west alleys have not been used for vehicular access, there <br /> have been numerous requests for alley right of way vacations, conditioned by an <br /> inclusion of utility easement. Portions of this alley, both east and west of this <br /> location have been vacated, with utility easements reserved for public and private <br /> utilities. The zoning code encourages and in some instances requires alley right <br /> of ways be used for vehicular access to garages and off-street parking in the Old <br /> Town residential areas. <br /> Staff referred this application to various City departments and utility companies <br /> providing service in the City. The Public Works Department as well as Xcel <br /> Energy both stated a need to maintain a utility easement in place of the alley. <br /> The ordinance reserves a public utility easement in place of the alley right of way. <br /> If approved, legal title to the vacated alley right of way shall vest in the manner <br /> provided by Colorado State Statutes. The Planning Commission forwarded a <br /> recommendation of approval of the alley vacation, with one condition requiring a <br /> utility easement be reserved in place of the vacated alley. The ordinance <br /> reserves a standard public utility easement in place of the alley right of way. <br /> Mayor Sisk opened the public hearing and requested public comment. There <br /> were no comments. <br />
