<br /> City Council <br /> Meeting Minutes <br /> April 4, 2006 <br /> Page 8 of 9 <br /> Council members Sackett and Marsella supported the in-kind services. Council <br /> member Muckle requested the funds come from the Business Retention funds. <br /> MOTION: Council member Sackett moved to approve the Contribution of In-Kind <br /> Services for CTC Corporate Challenge, seconded by Council member Marsella. <br /> Roll call vote was taken. The motion carried by a vote of 6-0. Absent - Mayor <br /> Pro Tern Brown. <br /> CITY ATTORNEY'S REPORT <br /> City Attorney Light reported Judge Balin has ruled in the Capitol Resource case <br /> that traffic accident reports are public records. He recommended the City follow <br /> the ruling of the Court and not seek any further action. He felt the issue could be <br /> addressed through state legislation. <br /> Council member Marsella asked if legislation could be passed through a local <br /> ordinance. City Attorney Light stated it would be difficult to address the issue <br /> with a local ordinance and stated it should be legislated at the state level. <br /> Council member Muckle voiced concern over the privacy issues and asked if the <br /> Court could clarify what should be redacted City Attorney Light stated that would <br /> require another judicatory hearing. He suggested working with state legislators. <br /> City Manager Simmons stated the Staff will continue to work with the CML and <br /> state legislators on this issue. He noted police accident reports have always <br /> been public records; it was this particular request procedure that was different. <br /> Mayor Sisk reported the City Staff met with legislators and a provision was added <br /> to a bill that would have closed the loop-hole; however the Press Association was <br /> against the provision, and it was dropped by the legislators. <br /> City Attorney Light stated according to Chief Goodman, members of the press <br /> obtain police accident reports through the normal police department procedures, <br /> however this particular request (Capitol Resource) came through the City Clerk's <br /> office. He suggested working with the CML and others to educate the Press <br /> Association and address their concerns. <br /> CITY MANAGER'S REPORT <br /> Assistant City Manager Balser reported on the Xcel Energy Permanent <br /> Compressor Station application. Potentia/locations are Marshall Road in Boulder <br /> County; the current location in Louisville, and 96th Street on the Schreiter <br /> property. The County Commissioners will hear this case in May. Staff discussed <br /> the issues with some firms and requested assistance to review the application as <br /> it relates to nuisance factors. She expected proposals by the end of the week. <br />
