The property is designated as Rural Preservation Area under <br />the Southeast Boulder County, South 96th Street, Dillon Road and US 287 <br />Comprehensive Plan Intergovernmental Agreement ("IGA"). Under the IGA, <br />Rural Preservation Area parcels are intended to remain unincorporated and in a <br />primarily agricultural or very low-density residential character, pursuant to County <br />zoning and development regulations. <br />The property is designated as subject to the IGA with a preferred land use of <br />Industrial under the Framework Plan of Louisville's 2005 Citywide <br />Comprehensive Plan. The Comprehensive Plan notes that an IGA amendment is <br />necessary to effectuate the preferred land use for the property. <br />Staff met with Mr. Lopez and Boulder County representatives to discuss options <br />for a mutual agreement regarding zoning of the property. Because Ordinance <br />No. 1456, Series 2004, would zone the property as Agricultural with a density <br />restriction, so as to maintain land uses consistent with the IGA, discussions have <br />focused on options for an Industrial zoning of the property. <br />These discussions have resulted in a proposal to move forward with a Hoyle <br />Property Amendment to the IGA. Under this Amendment, the property may be <br />zoned City Industrial upon arrangement being made for payment of a fee of <br />$14,000 per developable acre. The fee would be paid on pro-rata basis as <br />building permits are issued and the fees would be placed in a jointly managed <br />fund for acquisition of additional open space (either in fee or by conservation <br />easement) within the IGA plan area or the vicinity of Plan area. <br />If City Council supports the proposed amendment, discussions will continue with <br />the owners and the County to finalize a mutually acceptable draft. The proposed <br />amendment would be circulated to Broomfield and Lafayette for their approval as <br />parties to the IGA, and then brought back to City Council for final consideration of <br />both the amendment to the IGA and a revised zoning ordinance, which would <br />include first and second reading of the revised ordinance and an additional City <br />Council public hearing. As time has elapsed since the first reading of Ordinance <br />No. 1456, Series 2004, Staff recommended the ordinance be continued. <br />Mayor Sisk requested an Applicant presentation. <br />Richard Lopez, 4450 Arapahoe Avenue, Boulder, CO Attorney representing the <br />Hoyle Family Trust, reviewed the process followed by the Hoyle family to have <br />their property annexed into the City. He noted there was litigation and the <br />property was eventually annexed to the City, however the zoning was <br />complicated by the IGA that overlaid the property. Since the annexation, there <br />has been discussion of a solution. This solution is acceptable to the Hoyle <br />Family and in compliance with Louisville Comprehensive Plan designation as an <br />ultimate use. It was his belief Boulder County will find this acceptable given the <br />
