They also offer a small <br />retail area where specialty dog foods and treats are sold, as well as a grooming <br />area. <br />The applicant estimates they have no more than 5 clients at one time, so the <br />parking and circulation on this site should not be an issue. There are two <br />driveway accesses off of South Street, which will provide adequate internal <br />circulation and there are on site parking areas that will more than adequately <br />serve the parking needs. <br />This request was routed to the review agents and the only comment received <br />was a request for a backflow prevention device to be installed in the structure <br />once this use is approved. The applicant has responded to the Public Works <br />request and states that a backflow prevention device will be installed prior to the <br />start of business operations. <br />The Planning Commission reviewed the special review use request on July 13, <br />2006 and passed Resolution 22 approving the special review use, with <br />conditions. Staff forwards City Council Resolution No. 39, Series 2006 with the <br />following condition: 1) Staff requests the structure must be equipped with a <br />backflow prevention device. If one already exists, then the device must be <br />inspected by the Louisville Building Department to insure compliance. <br />PUBLIC COMMENT <br />Jean Morgan, 1131 Spruce Street, Louisville, CO voiced her concern over the <br />noise level from barking dogs, the dog odor, dogs being walked in the <br />neighborhood and the clean up. She asked if there will be a night time caretaker <br />and how far the facility would be from a residential area. She also asked about <br />the required backflow device. <br />The applicant, Sarah Nissen, 1141 South Street, Louisville, CO addressed Mrs. <br />Morgan's questions. With respect to the noise level, the dogs will be constantly <br />supervised, and when they are outside, they will be separated from the <br />residential area. The dogs stay at the facility all day and are not walked in the <br />neighborhoods. With respect to the smell, the areas are cleaned daily and have <br />pea gravel flooring in the kennels. There will not be an overnight caretaker and <br />should there be any noise issues, they would take immediate action. <br />City Attorney Light explained the special review use permit is applicable to Ms. <br />Nissen only. Should there be a change in ownership a new special review use <br />application would be required. <br />
