<br /> City Council <br /> Meeting Minutes <br /> August15,2006 <br /> Page 9 of 13 <br />MOTION: Council member Yarnell moved to approve Resolution No. 38, Series <br />2006, seconded by Council member Marsella. <br />_ Mayor Sisk requested the motion include delegating the City Manager the <br />authority to negotiate the cash-in-lieu dedication with the applicant, in the <br />subdivision agreement, Page 1 0, Paragraph 4.1. <br />VOTE: All in favor. Absent: Mayor Pro Tem Brown and Council member <br />Muckle. <br />RESOLUTION No. 39, SERIES 2006 - A RESOLUTION APPROVING A <br />SPECIAL REVIEW USE TO OPERATE A DOGGY DA YCARE CENTER & <br />RETAIL AREA, 1111 SOUTH STREET, UNIT A OR B, THE DIVINE CANINE <br />(advertised Daily Camera 7/30/06) <br />Mayor Sisk requested a Staff presentation. <br />Planning Director Wood explained the applicant is requesting the opportunity to <br />utilize an existing vacated structure for a canine daycare and kennel. The <br />structure is located on a property in the industrial zone district once used as a <br />lumber yard. According to Section 17.12.030, of the Louisville Municipal Code, <br />"Kennels" are permitted in the Industrial (I) zone district as a Special Review <br />Use. In reviewing the definitions section of the Louisville Municipal Code, <br />"Kennel" is defined as "a lot or building in which four or more dogs or cats at least <br />four months of age are kept commercially for board, propagation, or sale." <br />Section 17.16.220 "Salvage yards, kennels and feedlots" states"... kennels shall <br />be located a minimum of 660 feet from any residential district." The applicant is <br />requesting relief from this required setback. The Planning Commission may <br />recall a special review use based upon complaints related to noise or other <br />operational characteristics. <br />According to the site plan, the design of this property, previously as a lumber <br />yard, provides adequate access, parking and circulation. Based on the existing <br />building square footage and the area there is a parking ratio of 1 space for every <br />100 square feet of building square footage. <br />The applicant has operated a canine daycare on an industrial property in <br />Lafayette for the past 2 years. They state they would like to relocate their <br />business to be closer to their existing client base in Louisville. Their hours of <br />operation are 7 a.m. to 6:30 p.m., 7 days a week. They primarily operate a <br />daytime daycare business where clients drop their pet off during the day and they <br />pick them up at night. However, they also offer overnight stay opportunities, <br />which could allow a dog to stay for up to two weeks. There are 3 to 4 employees <br />on site at one time, and no more than 40 dogs (they average 20 dogs a day) - <br />
