Absent: Mayor Pro Tern Brown and Council member Muckle. <br />RESOLUTION No. 38, SERIES 2006 - A RESOLUTION APPROVING A <br />PROPOSED THREE-LOT PRELIMINARY SUBDIVISION REPLAT, 333 EAST <br />STREET, CLEMENTINE SUBDIVISION, FILING NO.2 <br />Mayor Sisk requested a Staff presentation. <br />Planning Director Wood explained the applicant is requesting authorization of a <br />final subdivision replat of Lot One of the Clementine Subdivision to create three <br />lots out of one 2.98-acre lot. The Clementine Subdivision was originally platted <br />in 1987, plating a total of 4.03-acres, under single ownership, into two lots. Lot <br />One was platted as a 2.98-acre lot, and Lot Two was platted as a .91-acre lot <br />located at the northwest corner of East and Lock Streets. At the time of initial <br />subdivision approval Lot Two contained an existing residence, and Lot One <br />contained a group home. Lot Two is not within the scope of the subdivision <br />request. <br />The group home was authorized by a Special Review Use (SRU) in conjunction <br />with platting of the property. The group home was constructed and licensed as a <br />residential group home facility for 6-12 foster children. The current applicant and <br />owner is a successor in interest to those previous approvals. The SRU was <br />approved with three conditions, one of which placed a limitation on the number of <br />residential units, which could occupy the property. The condition limited <br />development on the 4.03-acre parcel to two residential units, or one residential <br />unit and one group home. Any increase in density or use was required as a <br />condition of approval to come back for review by the Planning Commission and <br />the City Council. Also, as a condition of approval the City agreed to defer the <br />installation of public improvements and the public-use dedication obligations of <br />the subdivider. The record reflects the City Council was willing to defer public <br />use dedication and public improvement obligations based upon the low impact of <br />the approved group home. The public hearing record reflects at such time when <br />there was an increase of density or use the City Council would then make a <br />determination as to the exaction of those improvements. <br />The Planning Commission reviewed the subdivision request both as a <br />preliminary and as a final. On April 20, 2006 the Planning Commission passed by <br />a vote of 8:0 a resolution approving a preliminary subdivision plat with <br />conditions. Final plans were submitted to staff on May 18, 2006 and were <br />reviewed by the Planning Commission at a special meeting on July 20,2006. <br />The Planning Commission approved the final subdivision plat request by a vote <br />
