All conditions of approval related to <br />structuring a new subdivision agreement which would secure the outstanding <br />public improvements and public use dedication obligations as initially deferred by <br />the City at the time of initial plat approval. It was acknowledged, in the absence <br />of a PUD development plan that certain development requirements would have <br />to be determined up on submittal of a PUD development plan. <br />The following is included in the Clementine Filing NO.2 Subdivision Agreement: <br />Density Limitation; Public Use Dedication; Drainage Requirement; and Street <br />Improvement Recovery. Resolution No. 38, Series 2006 is forwarded without <br />condition. <br />Mayor Sisk requested an Applicant presentation. <br />Rex Olson, Olson Studio, 700 Front Street, Louisville, CO stated this was an <br />unusual project, going forward with a subdivision agreement with no PUD in <br />place. Fortunately they have worked through this with the Planning Division Staff <br />and the City Attorney. He stated he did not have a formal presentation, but <br />looked forward to proceeding with this project. <br />City Attorney Light explained the property owner is City employee, Chief Building <br />Official Mike Jones. He was advised at the outset of the project that the Charter <br />ethics code rules and regulations would be followed. <br />Mayor Sisk asked Mr. Olson, as the applicant's representative, if he concurred <br />with the City Attorney's statement. Mr. Olson confirmed he did. <br />COUNCIL COMMENT <br />Mayor Sisk asked for clarification on the response from the adjacent property <br />owner, Mr. Randy Luallin. Planning Director Wood stated Mr. Luallin requested <br />the density restriction on the property be eliminated. The subdivision agreement <br />eliminates the density on Lot 1, but no action will be taken on Lot 2. <br />City Attorney Light explained Lot 2 is not being processed with this application. <br />He explained pursuant to the subdivision agreement there will be a cash-in-lieu <br />of land dedication requirement for each lot prior to any permits being issued. He <br />explained the final documents require information on the amount of the cash-in- <br />lieu dedication. He asked Mr. Olson how it would be calculated. <br />Mr. Olson stated the applicant proposes to have the property appraised as it <br />exists today, and it was his understanding it would be based on square footage. <br />Mayor Sisk suggested the City Manager be delegated the authority to negotiate <br />the dollar amount for the cash-in-lieu dedication. <br />
