Jon Lee, Colorado Tech Land Company, 2500 Arapahoe, Boulder, Colorado, explained <br />that they have refined the allowed uses since the first reading, and agree with staffs <br />comments. <br /> <br />Davidson called for anyone wishing to speak for or against Ordinance No. 1295, Series <br />1999. <br /> <br />NONE <br /> <br />Davidson closed the public heating and called for Council comments and questions. <br /> <br />Howard requested that Lee provide a summary of their intent. <br /> <br />Lee replied that their intent is that Todd's Gourmet Kitchen has placed Lots 3 & 4 under <br />contract and is currently processing a PUD for a gourmet kitchen with a delicatessen, an <br />eating place, and banquet/meeting rooms. This Ordinance needs to proceed the PUD <br />process for Todd's Gourmet Kitchen. <br /> <br />Sisk asked Wood for clarification that this zoning would be an upgrade in zoning, as <br />without a Special Review Use this could not even be considered. <br /> <br />Wood replied, yes. <br /> <br />Sisk suggested that, without exception, the Commercial Development Design Standards <br />& Guidelines be applicable to Lots 1-5, Block 1. He felt that the request for an upgrade in <br />zoning was a positive request; however, he would like an upgrade in landscaping for this <br />area. <br /> <br />Lee asked for clarification that if he chooses to develop another industrial building on <br />Lots 1 or 5, it must comply with the Commercial Development Design Standards & <br />Guidelines. <br /> <br />Sisk replied, yes. He explained that he would like to see the City receive this benefit for <br />allowing for a Special Review Use. <br /> <br />Lee replied that he would not be willing to do that. <br /> <br />Sisk asked Lee if there would be an agreement that the restaurants and financial <br />institutions would not have drive-throughs. <br /> <br />Lee replied that they could put it on the record that a drive-through would not be allowed; <br />however, this could be limited when it comes through for Special Review Use. <br /> <br />Mayer questioned the logic for requiring that some lots comply with the Commercial <br />Development Design Standards & Guidelines and not others. <br /> <br />28 <br /> <br /> <br />
