Sisk asked Tom Phare for a status report on the street between the Martin building on <br />McCaslin, and the buildings being developed to the south of that building. He explained <br />that he understands it is a private street, however, he has heard that there are some <br />concerns with the street. <br /> <br />Tom Phare, Public Works Director, agreed that it is a private street. He stated that he has <br />heard that there is internal conflict regarding who should build it and who should pay for <br />it, etc. He explained that some of the issues relate to proper enforcement of the full PUD, <br />once it's in place. He stated that he would be working with the Planning Department to <br />determine the absolute requirements to open the road. <br /> <br />Sisk replied that he is not asking the City staff to be mediators, however, he feels it is <br />important that the City take an affirmative role to assure the PUD is followed. <br /> <br />Bill Simmons, City Administrator, explained that he has been contacted by one of the <br />property owners, who had similar questions, and he is currently researching the issues. <br /> <br />Sisk reported that Louisville Associates, owned by Barry and Linda Morris, is having an <br />auction of nine properties on McCaslin Boulevard and South Boulder Road. He stated <br />that the lots are being offered for sale, without the improvements being erected. He <br />explained that this would require all nine property owners to come together and make the <br />improvements required by the PUD. He expressed concern for this and suggested that the <br />City Attorney determine what rights, if any, the City of Louisville has at this stage. <br /> <br />Davidson asked Sam Light, City Attorney, whether the City could place a lien for the <br />improvements against the lots, since they have been subdivided before improvements. <br /> <br />Light replied that the lots would be purchased, subject to the subdivision agreement, <br />which is recorded. He stated that he is looking at the subdivision agreement to determine <br />what restrictions it places on transfer of lots, if any, prior to completion of the <br />improvements. He explained that the other assurance that the City has is the improvement <br />guarantee, and he is researching whether a letter of credit or other improvement guarantee <br />is available. He stated that another option under review is to give specific notice to <br />potential bidders at the action of the obligations under the subdivision agreement. Finally, <br />he explained that he is also reviewing any remedies that the City might have, under State <br />law, which could potentially give the City the right to seek to prevent the sale.
